SflU ENDS SEPT. 30 CHICAGO UP) Broadcast stations that criticize individuals in publicly aired editorials are not required to grant time to the subjects of the criticism to reply, the U. S. court of appeals has ruled. The court overturned the Federal Communications Commissioners' 'personal attack' rule, which guaranteed to subjects of editorial attack a reasonable opportunity to respond over the air within a reasonable period of time.

The court also struck down an FCC ruling which held that stations which endorse political candidates must grant opposing candidates an opportunity to respond. "IX MEW of the vagueness of the commission's rules," the court said, "the burden they impose on licensees, and the possibilty they raise of both commission censorship and licensee censorship we conclude that the personal attack on political editorial rules would contravene the First Amendment." The court upheld a petition filed by the Radio-Television News Directors Association and eight radio and television companies. They charged that the FCC rules "pose a substantial likelihood of inhibit-i broadcast licensee dissemination of views of political candidates and controversial issues of public importance." The FCC order was handed down July 5, 1967, and was amended the next year, to enlarge categories of news-related programs which would be exempt from the order. completion of construction on its own, two-story studio building located next to the Parma-town Shopping Center. AS AN independent, WUAB will be programming syndicated reruns, motion pictures, interview shows and sports (including taped replays of Ohio State and Notre Dame football games this Fall).

Among the shows from previous network seasons being carried rerun basis by channel 43 are "The Untouchables," Patty Duke, "Gilligan's Island," "I Spy" and "Batman." The station will be showing at least one motion picture feature each day. WUAB becomes the area's UHF station, the others being Akron's WAKR (23), Cleveland's WKBF (61), Canton's WJAN (17) and WVIZ (25), the Cleveland educational station. LIKE at WUAB (UHF channel 43), the newest member of the northeastern Ohio television community. Operated by United Artists Broadcasting as an independent station, WUAB-TV starts broadcasiing at 9 a. m. Sunday. The new station will be using the WKBF (channel 61) transmitter tower (installation was done Thursday, which accounts for channel 61 being off the air until late afternoon), and with power comparable to the latter should be sending a strong signal into the Akron area.

BE IT ENACTED bv the Council of the Citv of Akron. Summit County State of Ohio: Section 1. That it is herebv determined to proceed with the improvement in the Citv of Akron of Breiding road from Betana avenue Independence avenue. Section 2. That said street shall be improved in accordance with the provisions of Resolution No.

590-1968, adopted July 2. 1968. and with the plans, specifications, estimates and profiles heretofore approved and now on file In the office of the Clerk of this Council by grading, draining, curbing, paving, planting trees, constructing concrete sidewalks and driveway approaches and installing water service connections, where necessary, together with the necessary appurtenances thereto. Section 3. That all claims for damages resulting therefrom that have been legally filed shall be inquired into before the commencement of the proposed improvement, and the Director of Law is hereby authorized and directed to Institute legal proceedings 1 a court of competent jurisdiction inquire into claims that have been so filed.

Section 4. That portion of the cost provided in the above-mentioned resolution of necessity to be assessed shall be assessed in the manner and the number of installments provided in said resolution and on the lots and lands described therein. Section 5. That the estimated assessments heretofore pre-pared and filed in the office of the Clerk of this Council be and the same are hereby adopted. Section 6.

The Clerk of this Council is hereby directed to deliver a certified copy of this ordinance to the County Auditor within fifteen days after its passage. Section 7. Subject to the provisions Section 727.24. Revised Code, the Director of Public Service of the City is herebv authorized and directed as soon as the funds therefor are available to make and execute a contract for said improvement with the lowest and best bidder after advertising according to law and the improvement shall be financed as provided in the resolution of necessity. Section 8.
