Saturday, March 3, 1979 20 Reno Evening Gazette CUP AND SAVEt I CalTRPA gives support to air quality blueprint earlier this year, but It has had no effect on commercial development, which has been suspended for the duration of the wet season by rules of the bi-state Tahoe Regional Planning Agency. In other business, the agency board approved two Tahoe City Public Utility District projects, giving the go-ahead for a $29,650 remodeling project of a filter building for conversion to a shower and locker facility, and a $70,000 water interconnection between the Dollar Point Subdivision and the Highlands area. final action on the ordinance. In general, the ordinance would require developers of commercial property to offset the traffic they would generate by providing other Improvements that would cut down auto emissions. They could make the tradeoff through such means as Improving the traffic flow in and about the project area, subsidizing local mass transit systems, bicycle trails, bus shelters and road improvements, and by promoting car pooling.

The ordinance was adopted on a temporary basis No psychic for defendant CITY The California Tahoe Regional Planning Agency governing board has given its support to a staff-drawn plan to upgrade and trol the air quality in the Lake Tahoe Basin. The plan contains such proposed air pollution control measures as requirements for annual vehicle maintenance and Inspection, home mail delivery, exclusive bus lanes, staggered work hours, automotive travel restrictions, parking controls and restrictions, a basin "user-fee" or entry charge, and priority treatment for car pools, bicycle trails, ptdestrian pathways, and intensive public bus service. The agency staff will present the proposal to the California Air Resources Board as its answer to air quality requirements set forth by the federal Clean Air Act. The plan eventually is scheduled to be presented to the governments of California and Nevada for their consideration as a means of state compliance with a federal requirement. The federal Environmental Protection Agency has said the basin has not been in attainment of air quality standards.

It ordered the two states to create a plan for attainment. In addition, the board, meeting Friday, reviewed a staff plan aimed at controlling vehicular pollution, known as its "indirect source review ordinance." rs I I I PJMJCNOTJCE NOTICE Of COMPtEIION the boiitd ot Reyentt.fiu Ihe University nl NevU'tu System, ot ling on lielkilt ot Ihe University ol Nevilda kwi.u, gives nonce lhat an lotis'sting ol LINK 433, PAkMihONS GROUND HOUR, Oft. He said that despite intensive efforts by the Keno police who discovered torn and bloodied clothing believed to belong to Ms.

Barber, they have not yet found her or her body, On a second request for $5,000 to hire investigators to interview the nearly 60 witnesses listed by the district attorney's office, McNabney was successful. Prosecutor Lane objected to that request explaining McNabney ceuld use the investigators in the public defender's office who are already on the county payroll. McNabney, a former deputy public defender, said he had a personal conflict with the defender's investigators, but did not elaborate. Judge Breen granted the expenditure, noting that McNabney was the court appointed attorney in the case and that $5,000 was not an excessive amount for investigation in light of the nature and complexity of the case. A third motion to compel the production of wit-ness statements taken by the district attorney's office, beyond what state statutes require the district attorney to produce, was denied by the judge.

John Mazzan won't be getting a psychic at county expense. District Judge Peter Breen Friday rejected a bid by defense attorney Larry McNabnev to have the county foot the bill to have a psvehic attempt to locate a second possible victim in the Richard Minor slaying case. Mazzan, 32 is being held on a charge of murder in connection with the Dec. 21 stabbing death of Minor, son of Reno Justice of the Peace Richard Minor. McN'abney asked the court to approve spending up to $1,000 so he could hire a psvehic to find April Barber.

Minor's assailant is in this cour-toom," an obvious reference to Mazzan who was seated at the defense table McNabney, who said after the hearing he would go ahead and hire a psvehic with the help of contributions from Mazzan 's friends, argued that while the request may be unique and unpre-cendented locally, psychics have been consulted nuaru luemueis asKt-u siaii meinuei iu cianiy some of the proposed regulations before they take Rent control order i i 1 1 et 4 rmea sun in euea A bid to dissolve a temporary restraining order preventing a Verdi mobile home park from collecting higher rents was rejected by District Judge Peter Breen Friday. Robert Spitzer, attorney for Dr. Clyde Emery, owner of Glen Meadows Mobile Home Village, PUBLIC NOTICE Area deaths claimed the 60-day restraining order was too long and not permitted by statute. However, attorneys Virgil Dutt and Dale Murphy, representing the approximately 100 tenants who are suing to prevent the rent increase. said the 60-day period was set to accommodate Dr.

Discovery is a pre-trial investigation by each side to a lawsuit to discover facts held by the other side. Breen said there were, "Obvious difficulties in the lawyers cooperating; extreme problems." One of tiie difficulties, as outlined by the tenants' lawyers, was the necessity for them to travel to Los Angeies Ic take the doctor's deposition statement. Because of his surgery schedule and an outstanding arrest warrant against the physician in Nevada.

Spitzer said it would be difficult for Dr. Emery to come to Reno so he could be quizzed by the lawyers prior to trial. Dr. Emsry is one of several mobile home park operators against whom criminal charges have been filed by the Consumer Protection Division of the Washoe County District Attorney's Office. The physician is wanted in Nevada on a complaint charging two counts of accepting entrance fees, a misdemeanor.

Judge breen, refusing to order Emery's appearance in Nevada at this time, did agree to shorten the tempor ary restraining order to the time set fcr the hearing on a preliminary injunction. That hearing is scheduled for April 2. A private funeral was held today at the O'Brien-Rogers and Cresbv Funeral Home for Olga J. To-, pinka. 67.

Kell Houssels pioneer Las Vegas hotel-casino executive and nationally known sportsman, has died at age 83. Houssels was admitted to earlier this week to Southern Nevada Memorial hospital for treate-ment of chronic illnesses. His death Friday was attributed to diabetes. Recognized as one of the outstanding figures in the growth of Nevada gaming, Houssels acquired one of the first gaming licenses in Las Vegas. In 1930, he became an owner of the Srnoke House, subsequently named the Las Vegas club.

At the time of his death, he was chairman of the board of the Showboat Hotel, of which he had been an owner since its opening in 1954. He had served as chairman of the Tropicana Hotel and Country Club and had also been an owner of the Boulder Club, El Cortez and the Golden Nugget. Houssels also won national recognition for developing one of the West's great thoroughbred racing stables and breeding farms. His stable was the leading money winner in the 1963 Hoilywood Park season. Houssels was born in Vernon.

Bryan: Quote out of context LAS VEGAS (AP) Attorney General Dick Bryan said Friday a statement attributed to him that Gov. Robert List should report all complimentary services he ever received was taken out of context and "blown out of proportion" by the news "I think there was a lot of misunderstanding attributed to that question," Bryan said in an impromptu news conference prior to an address to the Southern Nevada Investigators Association here. He was quoted Tuesday, in endorsing a state policy governing the acceptance of comps, that List "should make a statement once and for all on the amount he received." But he said Friday that he was referring to his belief that List should make a general statement on whether comps should be accepted. "The first question asked was whether I agreed with a Washington Post story that suggested that the governor of any other state might, be recalled for accepting comps, and do 1 agree that that should be the case here," Bryan said. "I said I did not." Another question posed earlier this week, he said, was whether he believed a grand jury should be called to look into acceptance of comps by Nevada officials.

Again, he said, he responded that he did not believe so. The third question, he said, was if List should respond on the issue of comping. "I told the media I believed the governor should respond," Bryan said. "Apparently they took that comment to mean reveal all his comps." Asked for comment today on Bryan's allegation, Robert W. Ritter, executive editor of the Reno Evening Gazette and Nevada State Journal which published the original interview with Bryansaid the newspapers stand Pedestrian killed A pedestrian crossing Kietzke Lane against the light late Thursday night was killed when he walked into the path of a 1978 Chevrolet Blazer, the Reno Police Department reported.

Marvin "Buzzy" Wheeler, 52, of 25 Reservation Road was killed at 11:34 p.m. when he was hit by a vehicle driven by Leonard S. D'Anna, 39, of 1205 E. Robinson St. in Carson City, police said.

Police said Wheeler, who was released from the Reno City Jail at 4 p.m. Thursday after an arrest for intoxication, was apparently inebriated at the time of the accident. Wheeler had a police record of more than 200 arrests including numerous charges of intoxication, in past years, police said. He was a one-time amateur boxer from Schurz. Police said the accident seemed to be a case of pedestrian error.

Officers said no citations had been issued and none probably would be. by the accuracy of the story..
