Scheduled to start in a site bounded by Campbell, Suit to Block Pension Denied Huey Long's Cousin Loses Claim to Ham, Eggs Plan The "Thirty Thursday" pension plan was over another legal hurdle today on its way to the ballot in the November 7 special election. Federal Judge Martin I. Welsh of San Francisco dismissed an injunc tion suit filed by Minor Pierce Long, of Oakland, cousin of the late Huey Long, who contended that a section of the "Ham and Eggs" plan infringed a copyright he held. He obtained a copyright in 1934 on literature about the "Ray system" of retirement payments.

Judge Welsh said an idea of a system of government could not be copyrighted. He refused, accordingly, to grant Long's petition to restrain Secretary of State Frank Jordan from placing the measure on the ballot. Long's attorney, John Corgiat said he intended to appeal the case to the U.S. Circuit Court. Judge Welsh's ruling, made yesterday afternoon, said "there is a similarity in plan and purpose and method of operation in Longs copyrighted system and the "Ham and Eggs plan.

But, he added, copyright on an exposition of system of government cannot -prevent the use of the system in tended." The court also declared there was no way Long could amend his pe tition "so as to state a claim entitling him to the reliefs sought." i ing rapidly. Construction on this group of apartment homes, which will be located between Tenth, Twelfth, Cypress and Union Streets, is scheduled to begin later in 1940. W. Langdon Post, consultant for the United States Housing Authority, which has earmarked $5,000,000 to be expended in the construction of low rental housing projects in Oakland, conferred yesterday with the Oakland Authority. Post said the new Government- owned and subsidized apartments will not compete with legitimate apartment house operators.

Rentals, including all utilities, will be approximately $16 a month, but the projects will be reserved for persons whose annual income is less than $1000 a year. SUIT ASKS PAY ON SEWER JOB Charging that City Auditor Harry G. Williams "wrongfully and unlawfully" withheld a $2495 payment on an outlet tunnel and sewer project contract, E. T. Lesure, Oakland contractor, has filed suit for that amount plus 7 per cent interest in Alameda County Superior Court, through his attorney, Thomas E.

Davis. The suit is also directed against the Globe Indemnity Company, who wrote Williams' $25,000 bond as an office holder. Early in 1938, the suit states, Lesure won the contract to build the Broadway Terrace outlet tunnel and sewer between Her-mosa Avenue and Landvale Boulevard. Former U.C. County Clerk Frank Hogan reported to the district attorney today that at least 300 fraudulent signatures had been found on referendum petitions filed in his office. "It is obvious that whole batches of the 'signatures' were written by one person," Hogan declared. He explained that outside in vestigators," who he did not otherwise identify, had called at the office and checked the signatures on petitions filed with those on the county's great register.

A deputy who worked with the investigators reported to Hogan that at least 300 names on the petitions were not on the great register. The petitions ask for a referendum on the Atkinson oil conservation act. Seaman Falls Into Estuary, Drowns Albert Clark, 36, second cook on the freighter was drowned last night when he fell from the vessel's deck into the Estuary. The accident happened at the Howard Terminal, where the Penn-sylvanian is docked. George Chapman, the first mate, dived overboard and spent 20 minutes in the water in a vain rescue attempt.
