Martinez ASSOCIATED PRESS SEATTLE Fourth-quarter profits at Microsoft Corp. were up 9 percent despite flat sales, in part due to a major jump in income from investments that helped the software giant beat Wall Street's expectations. For the three months ended June 30, Microsoft made $2,409 billion, or 44 cents per share, on sales of $5,804 billion, the company reported Tuesday.

In the same period a year ago, Microsoft made $2,202 billion, or 40 cents per share, on sales of $5,764 billion. Analysts who follow the Redmond-based Microsoft had estimated earnings of 42 cents per share, according to First CallThomson Financial. Shares of Microsoft finished the day on the Nasdaq Stock Market at $78.50, up 3 1.3 cents. In after-hours trading, shares rose to $78,875. Much of Microsoft's fourth-quarter profits came from 1 1 billion in income from its $23.8 billion in investments, up dramatically from income of $485 million a year ago.

The company has been criticized in the past for beating estimates through us," said Connors. "I see a lot of momentum moving into 2001." Some of that momentum will come from sales of the new Windows 2000 operating system, which Connors said is "on track" with Microsoft's projections. $956,519 in taxes on rent that the Sundowner Hotel and Casino of Reno owes. The South Lake Tahoe, company filed a petition asking the U.S. Tax Court here to overturn the Internal Revenue Service demand for the additional 1995-96 taxes. Two of the firm's three owners also own the Sundowner. "I don't have the authority to comment without the approval of my client," said Belan Kirk Wagner, a Sacramento tax attorney for Lake Tahoe Inn, a 304-room resort hotel.

The petition said the Lake Tahoe Inn Corp. is owned by Robert Mal-off, George Karadanis and Max Ho-seit, and that Maloff and Karadanis own the Sundowner, which rents from the Lake Tahoe firm the land and building where the Sundowner is located in downtown Reno. Despite being unable to collect $2.7 million in rent from Sundowner for 1995-96, Lake Tahoe Inn Corp. has been ordered by the IRS to pay taxes on the uncollected funds, the petition complained. Economists split over rate hike INFLATION from ID ammunition not only for economists who think the central bank will leave interest rates unchanged at its Aug. 22 meeting but also for those who believe rates may be raised. Those who favor leaving rates alone cited the low monthly core rate and pointed out that core inflation advanced at a 2 percent rate in the second quarter, compared with an increase at a 3.2 percent rate in the first quarter. Some analysts said those figures suggest moderating core inflation. Analysts in the camp of an interest-rate increase were uneasy that surging energy costs will spill over into other product prices and foment an upward drift in core inflation.

They cited figures that show core inflation rose at a 2.6 percent rate in the first six months of this year, compared with a 1.9 percent rate for all of 1999. On Wall Street, stocks slumped despite some strong profit reports by major companies and the mostly unsurprising inflation report. The Dow Jones industrial average had lost 68 points in afternoon trading. So far this year, overall consumer prices have been rising at an annual rate of 4.2 percent, compared with a 2.7 percent increase for all of last year. The pickup in this year's prices results mostly from rising energy costs.

In June, gasoline prices rose 8.8 percent, the biggest increase in three months. The surge reflects a number of factors including refinery capacity problems, tight inventories, higher crude oil prices and new environmental regulations. Wall Street: Technology stocks led the market lower Tuesday as investors locked in some gains from that group's rebound despite some strong profit reports by major companies and a mostly tame reading on inflation. The Dow Jones industrial average fell 64.35 to close at 10,739.92 after falling as much as 101 points during the session. Among broader market indicators, the technology-dominated Nasdaq composite index fell 97.73 to 4, 176.94, the Standard Poor's 500 fell 16.75 to 1,493.74, and the Russell 2000 index of smaller companies fell 8.90 to 536.28.

"In Sundowner's 1999 financial statements, Sundowner's outside auditors issued the warning that Sundowner may be unable to continue as a going concern." An IRS spokesman said the agency does not comment on pending tax cases.

The IRS notice of deficiency was issued March 14, and the agency has 60 days to respond to the company's June 20 petition.
