Friday, March 14, 1986 Appeals court to decide if groups can enter TRPA suit By Bob EgelkoMp SAN FRANCISCO Lawyers for a Nevada legislator, county supervisor, landowner and local development district asked a federal appeals court Thursday to be allowed to intervene in the long-running lawsuit over land use at Lake Tahoe. The would-be intervenors, who generally favor less restrictions on development, told the 9th U.S. Circuit Court of Appeals that their interests aren't adequately represented by the government agencies and environmental group already in the suit. A three-judge panel heard more than an hour of arguments and will rule later. The court ruled last July that a 20-year land use plan by the Tahoe Regional Planning Agency would fail to protect the fragile environment of the Tahoe Basin.

The ruling continued a June 1984 moratorium on most development at the lake until the TRPA, an agency with delegates from California and Nevada, produces a new plan that complies with federal law. The suit, filed by the state of California and the League to Save Lake Tahoe, has been deferred for the moment while negotiations continue on a new long-range plan. Thursday's hearing looked toward the possibility that the negotiations would fail to satisfy all sides and the case would rptiirn tn pnnrf exists and that the suit is improper. Abbott represents Assemblyman Louis Bergevin, R-Gardnerville; Robert Pruett, chairman of the Douglas County Commission and a member of the TRPA, and Nathaniel Hellman, a Lake Tahoe property owner. He said they would offer arguments that current parties in the case aren't making: that the TRPA went out of existence by missing a legal deadline for a valid land use plan, and that California should not be allowed to file a suit in federal the TRPA, an agency which ft provides delegates and fund-- in Thursday by lawyers for Nevada, California, the TRPA and the League to Save Lake Tahoe.

TRPA lawyer Louis Doescher told the court that Abbott's clients had no unrepresented legal rights at stake in the dispute over the TRPA plan. Doescher said they were free to file their own suit challenging the agency's existence. Another bid to enter the case was made on behalf of the Incline Village General Improvement District, which operates various public services in the Nevada community. Attorney Richard Shanahan said the district has unique interests at stake in the TRPA dispute. He said the building moratorium had cut into the district's revenues from development permits, park fees and property assessments.

Also, he said, the district's steep terrain gives it a particular interest, not shared by other local agencies, in lifting a ban on building in erosion-sensitive areas. But Clement Shute of the League to Save Lake Tahoe said the same interests are already represented in the suit. He said the Tahoe Truckee Sanitation District in California is arguing that the moratorium causes undue financial hardship, and the TRPA has defended its proposed plan that would allow some development in sensitive areas. The Incline Village intervention, rejected earlier by Judge Garcia, was also opposed by the state of California. Lawyers for Nevada and the TRPA took no position.

He was ordered to spend nine years in prison for his role in rigging $1.6 million in jackpots. If included in the book, Vaccaro would become the first cheater to be listed among people excluded from Nevada casinos. Under Nevada gaming regulations, if a casino owner knowingly allows a person listed in the Black Book into a casino, the casino's gaming license could be revoked. LAS VEGAS (AP) Former casino owner Carl Thomas and convicted slot cheat John Joseph Vaccaro Jr. will be considered as possible candidates for Nevada's Black Book at a special March 21 meeting of the Gaming Control Board, member Guy Hillyer said Thursday.

If the board recommends inclusion in the book, and the Nevada Gaming Commission follows the recommendation, the two men would be barred from entering any casino in the state. The book, formally known as the List of Excluded Persons, now contains names of 11 men, all reputed associates or organized crime figures. The last person to be included in the book was reputed Las Vegas mob leader Anthony Spilotro, listed in 1978. Thomas, the former owner of the Bingo Palace and Slots-A-Fun casinos in Las Vegas, was convicted in Kansas City of skimming from the Tropicana casino in By Pat HarrisonGazettfKJournal CARSON CITY University' of Nevada-Reno students may have to reach deeper into their pockets next year to meet increases approved Thursday in student health-care fees and room and board. A Board of Regents committee approved increasing the voluntary student health-care fees from $30 to $35 per semester beginning next fall, The increase will keep the financially strapped Student Health Service afloat for another year while a long-term funding solution is studied.

UNR President Joe Crowley said he hopes to have an answer to the problem by tarly 1987. In addition, a $10 late fee would be charged to students who opt for the service after the semester begins, The committee also raised dorm rates by 4 percent to cover higher utility costs and boosted meal rates by 1 percent. Residence hall rates for double occupancy would increase from $1,200 for two semesters to $1,250. The most expensive meal plan would cost students $1,030, up from $1,020. The full Board of Regents will vote on the recommendations today.

Faced with budget shortfalls last year in both intercollegiate athletics and student health services, UNR shifted the $2-per-credit student fee for health care to athletics under an emergency reallocation leaving about 90 cents per credit for health. The health-care service was then made available for a voluntary $30-per-semester fee. The move drew fire from those who said UNR had put athletics above student health. Crowley told regents Thursday both Associated Student leaders and the student Senate approved the $5 increase so health-care services would not be reduced. Ted Lancaster, UNR student president, said a survey of 550 students found 72 percent wanted some sort of voluntary program.

The Student Health Advisory Board, convened by Crowley to find a long-term funding solution, listed the $5 increase as one of five recommendations. That recommendation was approved by Associated Student officers and the student Senate. Another option, having the School of Medicine on campus operating the service, is "not workable" at present, Crowley said. Last semester only half of UNR's eligible students about 3,500 paid the voluntary fee. This spring 2,387 students opted for the service.

Panel slates hearing on Rite of Passage camp By Bill O'DrlSCOllGazetle-Journal Officials of the Rite of Passage Wilderness Camp, under fire for alleged abuse of its delinquents, will defend their program before the Mineral County Commission next Thursday in Hawthorne.

The commission will consider a continuation of the camp's business license requirements, and the possibility of a special-use permit to run the camp, noted for its rugged, spartan way of life. Camp Director Jim McHenry said he will give a presentation on the Rite of Passage program, where 30 young male offenders sleep in teepees and serve an exercise-filled, 90-day stay in the desert east of Schurz. The presentation is scheduled for 2 p.m. in the Mineral County Courthouse on A Street. The Mineral County Sheriff's Department is expected to complete its investigation next week into charges of child abuse and neglect at the camp.

The issue was brought to light in a letter by Reps. Harry Reid, and George Miller, claiming the camp operates on federal money in an "unlicensed and inappropriate program." The camp has also been investigated for health and fire safety violations, but McHenry said improvements have been made and plans are being drawn up for new buildings. The camp is licensed by the Walker River Paiute Tribe, on whose land the camp sits. given a 12-week extension Feb. 10.

However, the panel decided to reconsider its action in the wake of five deliberately set fires at the resort last month. Although there were no serious injuries in the fires, the board voted to reconsider its extension. Deputy District Attorney Mahlon Edwards said that unless the Dunes can prove hardship, it will not receive addi tional time to complete the retrofitting. But Dunes President Burton Cohen asked the board not to lightly dismiss the 2,000 employees at the resort and its $1.5 million bi-weekly payroll. He said not knowing the Dunes is in financial hardship when the resort is in U.S.

1916 in Pappa Bluff Missouri, lived in Reno since 1976. Mr. Street was a truck driver a logger. Married to Nellie in 1965. Surviving is his widow.
