The "Taco Bell dog" divorce case, as some Dallas legal observers tagged it, was pretty amicable otherwise no beefs over division of money or furniture or even the Garland, Texas, house where the couple lived in matrimony for five years. "Missy the .dog is the only issue," Guice 's attorney, Randall Warmbrodt, told state District Judge Craig Fowler last month. The jurist later e'nded the case with -a decision that's common when two-legged youngsters' are the ones caught in the middle: . . The woman got custody; the man got visitation. It's too soon to say whether the outcome is typical of courthouse cat- and dogfights pet-custody law is still in its infancy. But there's little doubt that humans are wilder than ever about their furry friends, and that the legal system is evolving in response. 'People are more willing to go to court and say how important these animals are to them," said Barbara Newell, Maryland-based staff attorney for the Animal Legal Defense Fund. Barbara Newell past. A few judges, for example, have decided cases using a "best interest of the pet" test usually reserved for human offspring. Beyond the custody realm, some courts have allowed owners of killed or injured pets to sue for loss of companionship, not just cash value. At least one state legislature has enshrined this right in , law. Of late, Newell has been filing friend-of-the-court briefs in custody battles around the country. One brief, in Washington state, concludes by urging a judge "to confirm the trend towards recognizing the needs and interests of companion animals involved in legal disputes. The life and welfare of an innocent dog are hanging in the balance." Such high emotion surged forth in Fowler's court. Guice, a 48-year-old AT&T technician, wept on the stand. Bennett, a 57-year-old word processor, testified that Missy's legal bill was worth it "if it saves her life." He accused her of keeping the pup from himf in violation of a temporary visitationr order; she accused him of a retaliatory petnapping. She said he recklessly endangered animals; he said she kept Missy cooped up. "These people love that dog more than some of my clients love their children," Guice's; attorney said in an interview. Yet Warmbrodt also acknowledged that the case had engendered its share of comic relief after a particularly emotional pretrial hearing months ago, he decorated his law partner's credenza with stuffed Taco Bell dogs. Beverly Storey, who represented Bennett,; said there were jokes at her law office, too.-"But I know where she's coming from," she! added. "I have pets, too, and I love them like" children." Bennett, who bought Missy as a baby last year after another of her dogs died, shows off a snapshot of the little wiggler snuggling with a toy replica. Overall, though, she finds little humor in the situation. "I worry every time he takes her," said' Bennett, who has an entire room set aside for her young prize and two older canine companions. "She hates riding in the car." Guice lamented getting so little visitation two weekends a month but expressed no regret over the expensive legal war.
