Nov. 26, 1978 7 A doesn't need governor' AUSTIN, Texas (AP) Texas governors no longer should have, any say in whether a prison inmate makes parole, a special legislative study committee recommended Saturday. "In the past, governors have sort of used that role to demonstrate that particular governor's philosophy about certain types of crime," said Sen. A.R.

"Babe" Schwartz, D-Galveston, a member of the special Senate interim committee studying the state parole system. Gov. Dolph Briscoe seems to have vetoed decisions from the State Board of Pardons and Paroles involving crimes committed with weapons, Schwartz said. The governor, who appoints the pardon board, has constitutional authority in pardon and clemency cases. Banana boat rescues freighter crewmen MIAMI (AP) A passing banana boat rescued nine crewmen of the freighter Cari Trader, which burned in the Straits of Florida, but three shipmates were missing in the water today.

"They said the other three were in a life raft that capsized shortly before the rescue," Coast Guard spokesman Norris Turner said. The freighter Lord Trinight found the nine survivors in a lifeboat about 30 miles north of Cuba considerably southwest of the area where the Coast Guard had been searching since receiving a distress call about 1:30 a.m. Friday. No other sign of the ship was found. The Lord Trinight remained in the area to look for the other three men, and a Coast Guard helicopter flew from St.

Petersburg early today to join the search. A cutter with another helicopter also was speeding to the area. The Cari Trader, a 160-foot motor vessel of Panamanian registry, had been en route to Miami from Belize in Central America when it radioed that it was powerless with a fire in the engine room. "Leaving ship. Fire out of control," was the last message heard.

Gubernatorial veto in parole decisions originates in a state law. At an earlier meeting, the committee heard that approximately 86 percent of paroles recommended by the board are turned down by governors. An estimated 13,000 parole cases reach a governor annually. The decision to strip governors of parole veto was unanimous of committee members present: Schwartz; Sen. Grant Jones, D-Abilene, committee chairman; and lay members Leroy Melcher of Houston, with Utotem stores; Bill LaRowe of Austin, of the Center for Correctional Services; and George Beto of Huntsville, former director of the Texas Department of Corrections and now at Sam Houston State University.

A final report of the committee's recommendations will be "presented to the 66th Legislature in January. In addition to recommending abolition of the governor's veto, the panel also suggested that parole supervision be moved from the state parole board to another agency. The three-member parole board hears cases of inmates eligible for early release. The agency also has responsibility for keeping track of paroled prisoners. It is unfair to make the board take the blame for what happens after a person is paroled, Schwartz said.

Although the committee agreed to spin off the supervisory functions, it differed on where to assign that responsibility. Some members favored merging parole supervision with similar probation duties. Others felt the Department of Corrections, the state's prison system, should take the job. (AP Laserphoto) Rioters storm Frankfurt consulate FRANKFURT, West Germany (AP) Demonstrators protesting the rule of the shah of Iran tried to storm the U.S. Consulate in Frankfurt Saturday and were beaten back by police in a wild melee, authorities reported. They said apparently hundreds of persons were injured.

An estimated 7,000 Iranian. Turkish and West German demonstrators had marched through downtown Frankfurt to voice opposition to Shah Mohammad Reza Pahlavi's authoritarian government. The violence began after they left the prescribed route of the march to try to attack the multi-story, glass-and- steel American mission in the city's Westend district, police said. They said the attempted storming of the consulate touched off pitched battles between police and demonstrators on streets and squares throughout the district and on the nearby campus of Frankfut University. "Of several hundred police at the scene, hardly any escaped injury," said Frankfurt Police Chief Knut Mueller.

He did not give specific figures for the number of police and protesters injured, and it was not known whether any Americans were involved in the violence.
