The bank moved to dismiss the appeal because Mrs. Katlcman, and a minor child, Jennifer Lynn, had accepted monthly family allowances of $630 from the $325,000 Katie-man estate.

The bank contended that the family allowances came from th proceeds of the hotel stock sale and Mrs. Katleman and her daughter were thus precluded from appealing from the confirming order. The supreme court opinion, filed in the office of Clerk Ned Turner, held that the family allowances were a charge against the entire estate and not simply against the stock sale proceeds. By accepting the allowance, there was no waiver against the right of, appeal, the opinion read. It was written by Justice Milton Badt, with Justices Edgar Eather and Charles Merrill concurring.
