A petition signed by many voters of that ward and of other wards in" the city, urging the appointment of Wright, was read and Mayor Maurice Adams placed his name in nomination.

Councilman Albert Fick and Jeff Wallace immediately confirmed the appointment. Wright will be sworn in as soon as his official bond is approved, and it is expected that this will be at the next regular council meeting on April 21. A resident of Hawthorne for many years, the new councilman is a well known contractor, and substantial property owner in the city. He served as an officer in the carpenters' union for many (5)90 75 Mk Lf ix it' i "10-18 "'V The Nevada Supreme Court, in an opinion handed down Thursday, upheld the Clark county district court in allowing sale of stock in the estate of Jacob (Jake) Katie-man of Las Vegas to satisfy creditors. The sale involved 495 shares of stock in Elranco, the firm which leases and operates the Ei Rancho Vegas hotel.

The stock, plus a note from the estate, was sold for to Beldon R. Kat-leman, a nephew of the deceased. Mrs. Liberty Katleman, the wicTow, and her minor daughter, Lynn Katleman, brought the suit against Belden Katleman and the First National Bank of Nevada, co-administrator of the estate, seeking to have the sale set aside. She contended that the stock was worth at least 5250,000, and that the court abused its descre-tion in allowing the sale.

Katleman, who died in June, 1950, was one of the major stock-' holders in Elranco, Inc. Assets of his estate, in addition to the stock, were valued at $36,000. Debts amounted to $160,000. In upholding the decision of the lower court, the supreme court recognized that District Judge A. S.

Henderson was faced with the problem of whether to risk the chances of creditors losing at least a part of their claim by reason of the hazards of an "uncertain enterprise." Elranco, is not the owner of the El Rancho Vegas, the court pointed out, but represents only a gambling syndicate which holds a lease to operate the property. Through the sale of stock, the court held, payment in full to creditors was assured and a "substantial amount" was left for heirs. In the Clark county trial, the value of the stock was placed at $96,368 by a certified public accountant employed by the First National Bank. The stock was sold to Beldon Katleman for $102,868, with the- note bringing the total amount to $184,500. The supreme court decision, filed with Clerk Ned A.
