Genova will not run for re-election this fall a move that may pave the way for Assembly Speaker Chuck Hardwick, who faced retiring from public life, to stay in the Assembly. Genova, R-Union, announced yesterday he would not seek a third two-year term because of job and family obligations. He said he had been considering the move since February but only made a final decision Tuesday. The move opens the way for the Union County GOP organization to name a replace- Assembly because he was running for the GOP nomination for governor.

If nothing changes, Hardwick, who has been in the Legislature since 1978 and who came in third in the gubernatorial primary, would see his legislative career come to an close or at least interrupted at the end of this year. Genova said he was not pressured to step down and that Hardwick's loss in the gubernatorial primary had nothing to do with his decision. He said he originally filed for re-election and ran in the primary, which he won unopposed, because he was having difficulty making up his mind. He had been offered a promotion at his company, Gulf Coast Services, if he decided not to run for re-election, Genova said. But, he added, the firm would have backed him if he decided to remain in his current position of regional manager for the Houston-based financial consulting firm.

His new position as director of governmental affairs will require more travel and time, he said. In addition, the change will allow him to spend more time with his children. Frank X. McDermott, the new Union County GOP chairman, said he is unsure of the procedure or timing for naming a ballot replacement. "But we may have a problem of geography" here," McDermott, a former legislator, said.

Hardwick is from Westfield, one of Union County municipalities included inrthe' district, as is Ronald J. Frigerio, the person backed by the party to be Genova's Assembly running mate. McDermott said he hadn't really ered the issue, but "in my 12 years in the Legislature we always had" representatives from different geographic areas. Arnone, accompanied by his wife and five children, said after the swearing-in he hopes to use his experience on the local level in dealing with state issues. "As mayor of Red Bank for the past II years and a councilman before that, I know first-hand the concerns of the citizens in my district," Arnone said. As a councilman, Arnone, 56, headed the police and fire committees. He is active in the Knights of Columbus and B.P.O.E. No.

233 in Red Bank. He has had a dental practice in Red Bank for 28 years and plans to continue the practice. He also plans to continue as mayor until the end of his term in December 1990. Arnone said he will run for a full two-year term to the Assembly in November. His running mate will be Assemblywoman Clare Farragher.

They will face Democratic opponents Marlboro Township Councilman Frank G. Abate and Freehold Councilwoman Lynn Reich. Bennett will be running to complete the last two years of the four-year Senate term. His Democratic opponent has not been selected as yet. The third Monmouth County representative appointed under the new system is Democratic Sen.

John D'Amico, who was appointed to replace Frank Pallone when Pallone was elected to Congress. He is running for election in November to complete the last two years of the term. Republican Assemblyman Joseph A. Palaia is challenging D'Amico. Bill targets drivers who flee police Press State House Bureau TRENTON Motorists who kill or injure others while trying to elude capture by the police would face tougher penalties under a bill released yesterday by an Assembly committee.

The bill (A-3435), sponsored by Assemblywoman Joann H. Smith and Assemblyman Joseph M. Kyrillos both R-Monmouth, won release from the Assembly Judiciary Committee and now heads to the full Assembly for consideration. Under the bill, motorists who exhibit an extreme indifference to human life and cause another person's death while attempting to elude a police officer could be convicted of aggravated manslaughter, a first-degree crime punishable by 10 to 20 years in prison. Motorists who cause another person serious bodily injury while attempting to elude a police office could be convicted of third-degree aggravated assault, which is punishable by three to five years in prison.
