The Cincinnati pitcher told an Essex County court yesterday that he never "kneed or booted" Ulysses Ross, 36, out of his tavern. Ross, a former East Orange policeman, charged that Don and his brother Norman tossed him from the tavern Dec.

22, 1957, and that Harold Newcombe, another brother, threatened him with a gun. Don said Ross entered his tavern on the night of Dec. 22, 1957, grabbed him by the coat lapels and asked why a friend of his had been barred from the tavern. At this point, Don added, a patron asked him it he wanted to go to a Christmas party. Don said that Ross grabbed his right arm as he tried to leave the bar.

"I wrenched free and grabbed him by the back of both of his arms and walked him in front of me toward the door," Don testified.
