Blakey said that the issue of whether injunctions can be granted against tax commission orders is not before the court.

"What is under examination here is whether the reversal by the district court of the tax commission order is proper." All the injunction did, he added was to "prevent gross injustice." E. Frandsen Loomis, special tax commission counsel, argued, however, that effective control of gambling would end if injunctive relief were available to all whose licenses are revoked by the commission. The evidence jn the Thunder-bird case was sufficient to lead "reasonable men" to the conclusion reached by the commission in the revocation case. SEES 'UNFAIRNESS' Blakey, in morning arguments, had declared, however, that a thread of unfairness ran through the tax commission hearings and that strong effort had been made to justify a conclusion that the commissioners already had reached. The interest of the court was shown in many questions the justices proposed to counsel, and the fact that arguments contin ued through much of the after noon.

The supreme court rarely permits this and it was only the second time in recent years it has been done. The standard rule is one hour of argument arh side durine the morning. Blakey had argued that the "fatal gap" in the tax commission case was lack of evidence to show that Hicks knew that Lansky supplied part ot the money Sadlo had loaned to the hotel operation. He also asserted that Hicks had reported the Sadlo loan to various tax commission representatives, including its chief auditor and the secretary Robbins E. Cahill.

Justice Charles Merrill asked Loomis at one point if the tax commission case did not rely in part, on "presumption upon an inference," but Loomis said it was a "matter of common repute" that Lansky and Sadlo were hidden partners in the casino. The justices have a lengthy record made before the tax com mission and in the district court hearings to study and no decision is expected immediately. Funeral services were held Thursday afternoon for Albert Gotchy who died at his home in Chester March 25.

He was 88 years old. Mr. Gotchy operated a store at Janesville for about 45 years and moved to Chester nine years ago. He was a member cf the Janesville Grange. Surviving is a daughter, Mrs Gladys M.
