Capone spent most of the time following his release at his swank estate on Palm Island, Miami Beach, Fla. Federal agents be-, lieved Capone was worth at the time of his conviction. Occasionally there were unofficial reports Capone had visited Chicago, scene of his norotrious career, and his old vacation haunts in northern Wisconsin near Mercer. The most recent of such reports came from James M. Ragen, racing news publisher assassinated last year, who told authorities Capone and his family still controlled Chicago's rackets.

Former Capone associates here ridiculed the charge, one of them stating-publicly, "Capone is nuttier than a fruit cake." The one time boss of a prohibition era bootleg combine with an estimated "take" of $25,000,000 a year was indicted in 1931 for failure to file returns on $1,000,000 of income traced to him for the 1924-29 period. He pleaded guilty, expecting to gA a 2 year sentence but Federal Judge James H. Wilkerson of Chicago said "parties to a criminal case may not stipulate as to the judgment." Capone changed his pleo to innocent, was convicted and sentenced to 11 years and fined $50,000. He entered Atlanta penitentiary May 5, 1932. In 1934 he was transferred to Alcatraz island penitentiary, San Francisco bay, finished out his term at Terminal Island, Los Angeles, and was released to his' family in 1939 at Lewisburg, Pa.

Federal authorities said then he was suffering from paresis, a chronic brain disease causing loss of mental and physical power. Thereafter the sun and the sand of Florida augmented the treatment by his physicians. The federal records said Capone was born in Naples, Italy, Jan. 17, 1899. From a small time hoodlum role in New York, he was brought to Chicago in 1919 by Johnny Tor-rio.
