20 The Salina Journal Friday, December 11,1981 Phone call could violate open meetings law, AG's office says TOPEKA, Kan. (UPI) The state's meetings law fails to address the jissue specifically, but under certain conditions a telephone call among public officials about public business could be considered a "meeting," an attorney general opinion says. Deputy Attorney General Brad wrote the opinion, released 'Thursday, for the Lawrence mayor. In opinion addressing the issue of government, Smoot told the city clerk that the salaries and paycheck amounts of city employees were of public record. Attorney General Robert Stephen's 'office has issued several opinions on meetings for Lawrence Mayor 'Marci Francisco, who had asked whether members of the Lawrence City Commission could discuss over the telephone "an item upcoming on Hit agenda" or "general city business," and how the state's open meet- bigs law applied to such conversations.

The open meetings law does not specifically address telephone conversations, but Smoot indicated the law dould be liberally interpreted to in- clude some telephone calls in the definition of public meetings. One of the keys to the issue is determining whether the calls are "prearranged," Smoot wrote. Under the law, a meeting is "any pre-arranged gathering or assembly by a majority of a quorum of the membership of a body or agency subject to this act for the purpose of discussing the business or affairs of the body or agency." On a five-member commission, two members represent a majority of a quorum. So if two members of the commission were discussing public business over the telephone, it then must be proved that the conversation was prearranged to see whether the law applies, Smoot said. Conference telephone calls require some setting up, and thus may be considered prearranged.

However, it is harder to tell if a telephone call made by one member of the body to another without an earlier plan is "prearranged," Smoot wrote. "Unfortunately, there are no Kansas judicial decisions interpreting the meaning of the word he wrote, adding that other attorneys general and writers on the subject have interpreted it to mean the opposite of "chance." But Smoot had a word of caution for the mayor. "We do not believe the Legislature intended mere technology to effectively deny public access to the transaction of government business, and in our opinion, the use of a private telephone call to discuss and debate issues between members of a government body is clearly contrary to the spirit and, in some cases, the letter of the Kansas Open Meetings Act," Smoot wrote. In his other opinion, Smoot told Marion City Clerk Joan Bowers that both the net and gross pay to city employees was a matter of public record. The clerk said she asked for the opinion because a newspaper reporter had wanted a copy of the "warrants" or the net amount paid to employees.

She said she wondered if she also had to make public the gross amounts paid public, before taxes were removed. Rice also said that the stigma of being fired in early 1979 has prevented him from getting other employment. Since being fired from the year job, Rice said he has been "just like walking dead," traveling from city to city in search of a job. Sheldon Wulf testified that former city intelligence officers Lt. Pat Taylor and Officer Pete Dubovich had been assigned to put Rice under surveillance in an effort to build a case for firing him. At a hearing Wednesday, Wulf testified that both Taylor and Dubovich had told him last year they were assigned by Denton and Police Chief Richard LaMunyon to watch Rice. On Tuesday, both former intelligence officers had testified they had never tailed Rice and had never been assigned to put him under surveillance. Wulf, who has his own civil rights lawsuit against the city, was fired last April for refusing to answer LaMu- nyon's questions about a letter that Wulf wrote to the state attorney general, alleging wrongdoing in the Wichita Police Department.

Catholic church changes movie rating system WASHINGTON (UPI) The Catholic church is changing its film rating system, replacing its old "class condemned" and "class morally objectionable in part for all" with a single category called "0, morally offensive." Scheduled to go into effect Jan. 1, the changes will also use the word "recommended" for films of unusual merit in its category, according to anannounce- ment by the U.S. Catholic Conference. The changes essentially end the church's classification system which had remained substantially unchanged since its origin in 1934 with the Legion of Decency. 1.
