Harris today to rule on a motion to set an order setting aside a divorce. And upon his decision rests the marital status of Immigration Inspector James M. Haynes, 48, 529 North Street, Berkeley. The court took under submission the plea of Haynes' second wife, Elva Cano Haynes, 26, 2204 Sixth Street, Berkeley, to vacate an order made. by another Alameda County Superior Court judge last September.

That order set aside divorce obtained by Haynes first wife, Ruth and actually gave him two wives at one and the same time. It seems Haynes wed Wife No. 2 at Napa days after he thats divorced Wife No. 1. Not only is Wife 2 attacking the order which made Wife No.

1 still Hayne's spouse, but: she has filed a separate maintenance action seeking support for herself and four-months' old son, John. The complaint, filed with County Clerk G. E. Wade on August 25, says they separated June 30. Wife No.

1 had the divorce nullified on the grounds of fraud. She charged that Haynes lived with her up to the time the final decree was entered. And the second wife, represented by Attorney A. Q. Lomba, accuses the first Mrs.

Haynes of "rank and deliberate perjury." She described Haynes as a "weakling," who has been a "tool in the hands of this designing woman. and become frightened of his own shadow." S.F. Hotel Official Dies Suddenly John C. Newlands, 65, secretary of the Palace Hotel Company, died suddenly yesterday in his office at 74 New Montgomery Street. Newlands was also secretarytreasurer of Sharonk Company, managers of the vast estate of the late William Sharon, former United States senator from Nevada and partner of William Chapman Ralston, early financial figure in San Francisco.

Mid- Year Conference The mid-year: conference of the Northern California Dental Assistants' Association opened today at the Hotel Leamington, and will continue tomorrow. This evenning there will be an informal banquet which will honor Bernice Christensen, the president; Evelyn Jotter and Meriam Medlin, who have just returned from a National convention at Houston, Texas. Oakland Pedestrian Is Robbed by Pair Two thugs set upon Louis Anderson, 55, of 1104 21st Street, last night and robbed him of his wallet and $138. Anderson told police that was walking west on 20th Street to toward his home, when the men sneaked up behind him in front of 736 20th. One of the men felled Anderson with blow and then stunned him with more blows, apparently from his fists. The two then searched him and took his wallet. He described one man as 5 ft.

11 in. tall, 170 pounds and wearing a brown suit. The second man, he said, was about 5 -ft. 10 in. tall and weighed 160 pounds.

Both were about 30 years of age. Anderson was treated at Highland Hospital for minor abrasions about his head. Solano Hospital Superintendent Dies FAIRFIELD, Nov. Ebbert McFall, 51, superintendent of the Solano County Hospital at field. died suddenly last night at his home on the hospital grounds.

Dr. Felix Rossi said death was due to a heart attack. McFall was a native of Winters and had been active in the work of the Sacramento Shrine and Sui. sun Lodge of Masons. Survivors include his widow, Mrs.

Labor Council Ousts Brewery Units The San Francisco Labor Council night formally disassociated itself from locals affiliated with the Brewery Workers' International Union and ousted 13 brewery union delegates.

The action was taken on orders from William Green, president of the American Federation of Labor, under authority granted at the 1941 National convention in Seattle. It is a part of a Nationwide ouster against the union for refusal to give Jurisdiction, of the brewery drivers to the A.F,L. Brotherhood of Teamsters. Guilty Plea in Lottery Charge ALAMEDA, Nov. Goon Tom, 26, of 816 Oak Street, Oakland, pleaded guilty to possession of lottery tickets yesterday, and was fined $50 by Judge Daniel H.

Knox. Tom, represented by Attorney Leo Sullivan, changed his former plea of not guilty when he appeared in court yesterday. He had been arrested several weeks ago when some 500 Chinese lottery tickets and all paraphernalia for their use was found in his car by Alameda police. U.C. Masonic Club Schedules Dance BERKELEY, Nov.

Fort Dis. to Cochran Field (revoked) Work On Church Soon to Start Contract Signed for $40,000 Methodist Building at Richmond RICHMOND. Nov. will start here early next week on the large edifice of the Methodist Church of Richmond, to be located at the corner of 32nd Street and Barrett Avenue. Announcement of the signing of a contract for the work was made by Rev.

L. L. Loofbourow, pastor of the church. The contract was signed by E. E.

Phillips, chairman of the church board of trustees. Dybdahl Brothers of Richmond will do the work. Cost of the imposing new building will be about $40,000, according to Rev. Loofbourow. The architect's plans call for a Spanish type architecture, with the buildings constructed around twin patios.

Much of the interior decorations will be of tile. 'The was designed by Reginald F. Inwood, who also drew the plans for the new chapel at College of the Pacific and for the new church in Lafayette. Present contruction plans call for the erection of only two units of the structure--the church proper and a chapel, offices and permanent quarters for the beginners, primery and junior departments. A social hall will be added at a later date.

The church is being built on ten lots recently acquired by the church. The old building at Ninth Street and Nevin 'Avenue has been sold. FUNERAL MONDAY FOR HARRY A. MILLER Funeral services will be held Monday for Harry W. Miller, 73, of 672.

31st Street, veteran Oakland Post Office employee until his retirement eight years ago, who died yesterday, after native an of illness: Pine Grove, served as a route man and postal worker here from 1890 until 1933: He served the local postoffice under eight different postmasters, and was the oldest employee in point of service when he retired. He was a member of Oakland Lodge No. 118, I.0.0.F., and of the Retired Federal Employees Association. Billy couldn't tell anybody what he had swallowed. He was only two years old and a guy hasn't -much of vocabulary that young. But it was a cinch he had swallowed something, because his mother, Mrs. William A. Maska, of 1106 Santa Clara Avenue, could feel a lump in his throat.

She took Billy to the first aid station, but there was no instrument there that could answer the puzzle. So she took him to Highland Hospital. Billy was 50 excited he coughed and coughed and out flew something and clicked on the floor and the lump was gone. And what do you suppose it was An inch and a half of his mother's lipstick! Billy is back home now and feeling much better, thank you. Officer Addresses Richmond Rotary RICHMOND.

Nov. Don Thompson, U.S.N.R., was the speaker yesterday at the weekly meeting of the Richmond Rotary Club in the Hotel Carquinez. Thompson, a well known West coast sports announcer, is now on shore duty with the Navy. The annual Thanksgiving message was delivered to the club by Rev. L.

Financial Worries Blamed for Death Financial and family worries were blamed today for the suicide of Frank Vargaus, 41, of San Jose, who was found dead in a San Francisco hotel room by James Boccardo, attorney for Mrs. Vargaus.

Vargaus had written his wife he was "tired of it all." and the hotel stationery led to discovery of his body, an empty poison bottle beside it. Mrs. Vargaus said he had attempted suicide twice before. He had been missing 10 days. 10th District V.F.W.
