The communication which he sent to all department heads follows: "The tire rationing board gators inform me that they have observed the use of city cars and trucks conveying employees to their homes at lunch time or on other errands of personal nature.

"Obviously city equipment, tires and gasoline cannot be used for such purposes. I feel that this practice is not general, but the few who are using the city cars bring criticism 'on the city administration. C.M.S. and PORT ORDINANCE NO. 397. AN ORDINANCE LOCATING THE LOW TIDE LINE BETWEEN HARRISON AND ALIVE STREETS EXTENDED AND PROVIDING FOR A COMPROMISE AGREEMENT IN CONNECTION THEREWITH. BE IT ORDAINED by the Council of the City of Oakland and BE IP ORDAINED by the Board of Port Commissioners of the City of Oakland, jointly and respectively as follows: Section 1.

It is hereby found and determined: That by virtue of Statutes of 1941, Chapter 720, the State of California conveyed to the t'ity of Oakland a surface easement for harbor purposes over those certain lands lying waterward of the low tide line as it came to rest by natural causes between Harrison and Alice Streets extended, with full power to settle and fix the boundaries thereof. That 01 about the 27th day of January, 1941, the Superior Court of the State of in and for the County of Alameda, made and entered its certain judgment, in a proceeding then pending in said Court, entitled "City of Oakland, plaintiff vs. Thomas Hogan. et and numbered 118977 in the records of said Court. by which judgment the Court among other things, found and determined the loration of the line of ordinary low tide of 1, 1852 AM it came to real through natural causes and AM it became fixed by artificial dredging land filling, that is to insofar ax said low tide line extended between the southeasterly line of Harrison Street and the northwesterly line of Alice Street in the City of Oakland, County of Alameda, State of California; and that at the time of said judgment, said WALK rot the owner of the lands lying southerly or waterward of paid low tide line.

That prior to said judgment the ordinary low tide line bounding said lands never had been settled and is location is uncertain: that there has been artificial filling and dredging in its vicinity that the present line hof ordinary low tide differs materially from such line ax shown on ancient maps and charts. That because of the foregoing matters, a substantial uncertainty and controversy exists between the City and this Board on the one hand, and the owners of the littoral property adjacent to such low tide line, which tide line marks the boundary between the public salt marsh, tide and submerged lands the adjoining privately owned properties. That the uncertainty has and, if not settled, will continue to Interfere with the development of the areas affected by the public and by private land claimants; that it is to the best interests of the public and city and of such private owners that said uncertainty he settled and said tide line be determined and agreed upon. That 10 this end, public records, monuments, available maps and surrevs of early and subsequent conditions of the tide Une and other evidence obtainable have been examined, and negotiations carried on with the owners of the adjacent property, all for and on behalf of the city. for the determination and fixing of the true location of said line, and an agreement for the location thereof has been reached.

That as a result of such studies and negotiations it appears that said low tide line AN fixed by the Court in said judgment Ps reasonable and fair, and. to the interest, convenience and advantage of the public as well as the City and the private owners, and that the arrangement A8 agreed upon and herein set forth be carried jato effort. TE hereby is and determined that the true location of that portion of the line of ordinary low tide extending between the southeasterly line of Harrison Street and the northwesterly line of Alice Street, as said line came to rest hv natural causes following erosion and accretion. but prior to artificial changes by filling and dredging, is forever located, determined.

Hogan, and any other persogs who have or claim any title, right or interest in or lien on the properties thereby conveyed or confirmed to the City of Oakland, providing as follows, to- -wit: "(a) Each of the parties signing suck agreement and conveyance shall, following recital of the matters, Torth Section Tor This ordinance. and severally agree that said ordinary low tide line, as hereinbefore described, was and is the true line of ordinary low tide.

Hogan and other interested persons shall forever quitclaim to the City, its successors and assigns. all their right, title, claim and interest in and to those certain lands extended in the City lying between the southeasterly line of Harrison Street and the northwesterly line of Alice Street extended. and southerly or waterward of such agreed low tide line, together with all and singular the hereditamenta and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder or remainders, and rents, issues and profits thereof, excepting therefrom, those rights acquired by and secured to Thomas P.

Hogan in however, accordance with the terms of and subject to the conditions set forth in that certain franchise granted to said Thomas P. Hogan by the City of Oakland on February 3, 1941 by Port Ordinance No. 353, adopted by the Board of Port Commissioners of said City. (c) By such instrument the ('ity shall acknowledge and confirm that no portion of the land lying northerly of such agreed low tide line and between the southeasterly line of Harrison Street and the northwesterly line of Alice Street lies 'waterward of the line of ordinary low tide as it came to rest through natural causes, and that the City has no claim, right, title or interest whatsoever in or to said parcel. or any part thereof.

(d) Said agreement shall enure to the benefit of and be binding upon the successors and Clerk assigns of the Secretary respective of the parties. Board authorSection 4. The City and the are ized to attest the signing of such agreement by The Mayor and the President of the Board of Port Commissioners, respectively. Such aigning and attesting, when duly acknowledged and sealed with the official seal the City and the Board shall constitute due execution thereof by said City, Section 5. Said agreement shall be executed in quadruplicate and one executed copy thereof shall be furnished to said Thomas P.

Hogan and the others shall be retained by said' City of Oakland. Said agreement shall be prepared in form approved by the City Attorney and the Port Attorney, and the Council and Board shall take such further proceedings in the premises and cause the execution and recordation of such documents as may be required to carry out and complete the matters herein provided for. Harry T. Cassidy, chairman of the welfare service committee, declared today following a test mobilization. The entire staff of 216 volunteers responded to the test call at 11 welfare centers, where operations of each of five units were inspected and tested for efficiency, Dr. Cassidy said. Manuals showing medical aid centers, welfare service posts, fire, police and hospital locations and air-raid warden areas were distributed at a general meeting.

Labor Shortage In Non-War Work Worries Portland PORTLAND, April Portland's labor shortage in nonwar industries seemed today to be brewing the grandfather of all headaches for this shipyard-booming town. The shipyards, already employing thousands of workers who jam the busses and streetcars and fill all available housing, are expanding. More yards are under construction.

A. G. Johnson, of the U.S. Employment Service, has appealed for 15,000 men to take specialty training to be ready for the yards' production peak in September. Maurice Fischer, of the Longshoremen's Union, said 400 of the 1200 longshoremen were at work in the shipyards and men the docks were swamped.

He appealed for at least 100 to return from the ways. Daily addition of new men failed meet the steady increase of longshore work. Mildred Gianini, of the Laundry Workers' Union, said one-third of the membership had transferred to other work. Civil Relief Act Is Ruled Out of Divorce Case Here An attempt by a civilian employee of the Navy to invoke the and sailors' civil relief act in a divorce case in Alameda County overruled today by Superior Judge; John J. Allen. The divorce was granted to Mrs. Josephine Oakes Myers, 32, of 2060 Santa Clara Avenue, Alameda, from Glen Myers 30, an accountant employed by the Navy at Roosevelt Base, Terminal Island, San Pedro.

Myers claimed he was covered by the act, which automatically stalls! all court proceedings against soldiers, sailors or marines until 90 days after their discharge from service. Donald Quayle, who represented Mrs. Myers, pointed out that a person in the Army or Navy could not resign but that Myers could on it his position any time he desired. Judge T. W.

Harris had previously ordered temporary support of 860 per month for the couple's daughter, Sylvia, 9, and in effect had ruled the act was not applicable.
