CARSON CITY (AP) state Supreme Court Justice Al Gunderson has urged a federal appeals court to direct U.S. District Court Judge Harry Claiborne to assume Jurisdiction In a Nevada estate fee controversy. Gunderson, in a brief filed in the 9th Circuit Court of Appeals in San Francisco, said Judge Claiborne's court in Las Vegas might be a "better forum" to review the case involving Las Vegas lawyer Peter Flangas instead of Gunderson's own state Supreme Court. i The state Supreme Court intends to conduct disciplinary hearings against Flangas and anothr lawyer, University of Nevada Regent John Tom Ross of Carson City, as a result of the fees they sought in handling a millionaire's estate.

But the disciplinary hearings against Flangas were held up after he filed separate petitions in Judge Claiborne's court and in the 9th Circuit Court. Flangas faces the possibility of a two-year suspension and payment of $15,000. Lawyers for the state Supreme Court and for the State Bar have opposed those petitions. But Gunderson split himself off from the rest of the high court, and filed separate responses in both federal courts. The latest document from Gunderson states that a federal trial court could develop a proper evidentiary record.

He said no such record now exists in the case stemming from legal work on the estate of the Walter Hermann of Dayton. Gunderson also said Supreme Court Justices Noel Manoukian and Supreme Court Justice Cameron Batjer already have disqualified themselves from the disciplinary proceedings. And he said one of the district court judges who was to substitute took himself off the case as well. "This suggests that obtaining a panel in the Nevada Supreme Court, suitable to all parties, may be difficult If not impossible," Gunderson said. Gunderson also claimed that the judge problem "could well be enhanced" by publicity over the controversy.

He said judges asked whether they were biased might have to decide not only whether they felt biased but whether they were "unconsciously" biased by alleged "improper publicity." Gunderson also said that when Judge Claiborne ruled he lacked jurisdiction, he didn't deal with the "most serious issue" of whether or not he was bound by law to abstain from the case. Gunderson also said the Nevada Supreme Court "may be ill equipped" to address Flangas' claim that his civil rights had been violated by that court. Gunderson said there are allegations that the State Bar has a "financial interest in disbarring" Flangas but the Supreme Court lacks evidence in the record now before it to deal with those claims. The justice also said he has "no personal or Institutional stake in where such record is developed and such issues litigated." In related action, the 9th Circuit Court agreed to a request by the Nevada Supreme Court and the State Bar for an accelerated hearing on Flangas' petition. The 9th Circuit Court said the arguments would be scheduled in February 1980 or as soon thereafter as possible.

Attorney John Tom Ross of Carson City, a University of Nevada regent, also is involved in the case concerning the estate of the late Walter Hermann, a Dayton millionaire.

The state bar has recommended that Ross be disbarred. Flangas and Ross have both challenged the claim that they received excessive fees in the case. Each was awarded $35,000, more than the two Hermann daaughters they represented. Their fees were later cut to $6,000 each. LAS VEGAS AP) Former Nevada Supreme Court chief counsel William Richards has been granted the opportunity to tell what he knows about the court's activity leading to a plan to suspend attorney Peter Flangas from the Nevada State Bar.

U.S. District Judge Harry Claiborne ruled Friday that Richards could file an affidavit as a "friend of the court" in Flangas' suit against the bar association. Claiborne gave Richards, who until recently was the chief legal adviser for the court, until Dec. 21 to file the affidavit. Richards, in documents filed earlier this week in support of his intervention, claimed he could document the alleged "demise of intellectual honesty" and lack of "regard for justice and legal principal" among members of the high court.

Richards said in the document that he "truly regrets his duty to relate un Fire calls IN THE SECOND JUDICIAL DISTRICT COURT Of THE STATE OF NEVADA. Miss Vincent testified that buttons found in the ashes were from her clothing. Singleton didn't testify at his trial but said during the interview that the buttons were from his ex-wife's clothing. "I've got no ax to grind," he said. "I didn't destroy anything." But Singleton contended that after he picked Miss Vincent up, she threatened to poke his eyes out with a surveyor's stick, take off her clothes and claim that he raped her. Singleton denied during the interview that he had sex with Miss Vincent, a direct contradiction of a tape-recorded admission he made to police after his arrest.

The tape was played during the trial. "If I'd been tried for murder, I could care less," Singleton said. Rape? No." He complained that authorities have effort to substantiate my story. They refused to give me a lie detector test. "I'm not the beady-eyed monster you guys have made me out to be." Lawrence Singleton of Sparks has begun serving a maximum of 14 years and four months in state prison here for maiming and raping 16-year-old Mary Vincent in September, 1978. He maintained his innocence during an interview and contended that two male hitchhikers he picked up must have attacked Miss Vincent who was left along a remote road near Interstate 5 in Central California. Singleton, 52, a merchant seaman, admitted he had been drinking 190-proof grain alcohol and couldn't remember what happened after he allegedly picked up the two men.

No such men ever were found. "Don't think I haven't thought, 'could I have done he said. "Don't say I don't have compassion for her. Nobody should have their arms cut off." Passing motorists who found Miss Vincent staggering and bloody got medical help, and she has since recovered and learned to use artificial arms. The operations include tungsten, molybdenum, silver, gold and uranium, he said. And lie added that exploration also is booming in the oil, geothermal and building materials fields. Echoing Gov.

Robert List's recent speech to the Nevada Mining Association convention. Warren said the the "renaissance" started in the 1961 discovery of micron-s zed gold particles near Carlin. The first bonanza in Nevada was launched in the mid-1800s with the Comstock silver mines of the Virginia City area and the second was in the turn of the century Tonopah strike. Since the Carlin find, 22 important mines have opened, Warren said. He said that during 1978, more than $75 million was spent in hard rock mining exploration.

State officials estimate that another $10 million was spent looking for oil and $15 seeking geothermal resources, Warren added. Warren said uranium explorations seem especially encouraging. He predicted that "Nevada will become a major uranium producer within the next decade." And he said thousands of uranium mining claims have recently been filed. According to Warren, a series of major mining operations are expected to be launched during the next few years: Placer Amex discovery of uranium at the McDermitt Cordero in Humbolt County. Freeport Gold operation 50 miles north of Elko.

Warren said the discovery has the potential to surpass the output of the Carlin operation, and he noted the Freeport has ordered $60 million in production equipment. The Anaconda molybdenum discovery in entrance ot me Washoe Louny ourt- proposed as part of the Great Basin National Park, he noted. Chevron Resources, is considering uranium mining in the McDermott Caldera area. AgAu Co. has announced it may try to rework the gold and silver tailings of the old Elko dumps.

Cyprus Mining Co. is studying a gold mining operation at Northumberland. The Elko Victoria Mine, sold off by Anaconda, may be reopened by Day Mines of Idaho. Warren said it would be a very large underground mining operation. Ancelco has announced plans to mine gold northwest of Elko.

Kennecott plans to rework the tailings of its massive copper mining operation at McGill near Ely. Although actual open pit mining has halted due to falling copper prices and evnrionmental problems. Warren said "at least 20 years worth of reserves" remain. Silver King Mines recently has obatined financing for a major open pit silver operaytion in the Taylor District of White Pine County. Pinson Co.

plans to mine Carlin-type gold in Humboldt County. In Mineral County, Oxydental minerals has announced a major open pit silver operation at Cande-laria which is expected to produce 8,000 tons of ore a day. Climax Molybdenum soom probably will have three or four drilling rigs operating in intensive exploration near Battle Mourjtain. Placer Amex feels it has finally worked out a way to recover the ore at the big Cortez Mine near the Eureka-Lander County line. rto-wSe.
