Preceded in death by husband, Floyd, she is survived by sons, Fordyce Reese of Norton, Nelson F. Reese of Muncie, Bruce Reese of Cincinnati; ll grandchildren; and 17 greatgrandchildren. An area resident for 54 years, he had been employed by the Burger Brewing retiring with 23 years service, and then with the Cuyahoga Falls City Schools, retiring in 1989. He was a member of Immaculate Heart of Mary Catholic Church and the Retired Teamsters, and a past member of the Knights of Columbus, Immaculate Heart Holy Name Society, the Eagles and the Moose. He was preceded in death by parents, George and Nellie Wilcox; and brother, Ralph, and is survived by wife, Jennie, with whom he celebrated 56 years of marriage May 15; daughters, Toni Applegett of Tiffin, Carole Wallace of Dover, Elinor Wilcox of Randolph; son, Tim of Wadsworth; 16 grandchildren; ond three great-grandchildren. Peter Thomas Markovich 70, died Wednesday, May 30, after a long illness. An Akron native, Mr. Markovich was a graduate of St. Vincent's High School, and had attended the University of Akron. 1980, he retired from General Tire after 40 years of service.

He was a member of St. Matthew's Catholic Church. His survivors include his wife of 47 years, Maxine daughters and son-in-law, Sandra L. and Stephen Weber of Canal Fulton, Susan Kay Markovich of Cuyahoga Falls; son and daughter-in-law, Peter Thomas Jr. and Laurel of Akron; grandchildren, Stephanie and Jeffrey; sisters, Catherine Collert of Hudson, Mary Kolar of Clinton; brothers, Michael V.

A resident of Barberton for most of his life, he was a member of Johnson United Methodist Church, National Masonic Lodge 568, a member and past president of Barberton Kiwanis, on the Board of Trustees for the Salvation Army, and a volunteer for Barberton Citizens Hospital. He delivered Mobile Meals in Akron, retired from Babcock Wilcox with 43 years service, and was a World Wot II Navy veteran.

He is survived by his wife of 50 years. Born in Akron, he lived in Northwest Valley for 31 years. He was employed as a tool grinder, and was a World War II veteran. Surviving are his wife, L. Genevieve Hazel; and son, Thomas Glenn Hazel.

Kathryn T. Friend Ingram Kathryn T. Friend Ingram, 86, passed away May 31, 1990 at Akron City Hospital. Mrs. Ingram was born in Fordyce, and had been a resident of Akron for 66 years.

She had worked as a secretary at Goodyear Tire Rubber and the M. O'Neil Department Store. She was a member of the Goodyear Wingfoot Girls, and also a member of the Goodyear Heights Presbyterian Church, where she was active in the choir and Fidelis Bible Class at the church. She is survived by daughter, Verna Friend of Cuyahoga Falls; sisters, Mrs. Alma Rutan of Hartville (formerly of Akron), and Miss Verna Hornaday of Fordyce, Ark.

This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and of any of Ms committees that resulted in those formal actions were In meetings open to the public in compliance with the law. If any, as may be necessary so thai the Note will not constitute arbitrage bonds under Section 148 of the Internal Revenue Code of 1986. as amended (the Code). The Director of Finance, as fiscal officer, or anv other officer, including the Treasurer, having responsibility for the issuance of the Note shall give an appropriate certificate of the Citv, for inclusion In the transcript of proceedings for Ihe Note, setting forth reasonable expectations of the City regarding the amount and use of all the proceeds of the Note, Ihe facts, circumstances and estimates on which thev are based, and other facts and circumstances relevant to the tax treatment of Ihe interest on the Note. The Citv covenants that II (a) will lake or cause to be taken such actions thai may be required of it for the interest on the Note lo be and remain excluded from gross Income for federal income lax purposes, and (b) will not lake or authorize to be taken any actions thai would adversely affect lhal exclusion, and that it, or persons acting for it, will, among other acts of compliance, (I) apply the proceeds of the Note to the governmental purpose of the borrwoing, (II) restrict the yield on investment property acquired with those proceeds, (Hi) make timely rebate payments to the federal government, (iv) maintain books and records and make calculations and reports, and (v) refrain from certain uses of those proceeds, aM in such manner and to the extent necessary to assure such exclusion of that interest under the Code.

The Director of Finance and other appropriate officers are authorized and directed to take any and all such actions, make calculations and rebate payments, and make or give such reports and certifications, as may be appropriate to assure such exclusion of that interest. Section 11. The Clerk of Council Is directed to tor-ward a certified copy of this ordinance to the County Auditor. Section 12. This Council determines lhat all acts and conditions necessary lo be done or performerd by the City or to have been met precedent to and In the issuing of the Note In order to make It a legal, valid and binding general obligation of the City, have been performed and have been met, or will at Ihe time of delivery of the Note have been performed and have been met, in regular and due form as required bv taw; that the full faith and credit and general property taxing power (as described in Section 9) of the Citv are pledged for the timely payment of the debt charges on the Note; and lhat no statutory or constitutional limitation of Indebtedness or taxation will have been exceeded in the issuance of Ihe Note.

Section 13. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted In an open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted in those formal actions were In meetings open to the public in compliance with the law. Section 14. This ordinance Is declared to be an emergency measure necessary for the Immediate preservation of the puollc peace, health and safety of this City and for the further reason that the immedite effectiveness of this ordinance Is required for Ihe issuance and sale of Ihe Note, which is necessary to enable the City to enter into a construction contract to provide ihe improvement described above, which is urgently required to eliminate existing hazards to pedestrian and vehicular traffic and the health and property of the residents of the Citv, and provided this ordinance receives the affirmative vote of two-thirds of the members elected or appointed to Council, It shall take effect and be In force immediately upon Its passage and approval bv Ihe Mayor; otherwise, It shall take effect and be In force at the earliest period allowed by law. She was a member of the Wadsworth First Christian Church, the Bethany Class, Martha Circle, and Wadsworth Chapter 102, O.E.S. She enjoyed quilting and cooking. Section 6. So long as the Note remains outstanding, the Director of Finance shall maintain and keep at his office alt books and records necessary for Ihe registration and transfer of the Note as provided in this Section (the Note Register).

The person whose name the Note is registered on the Note Register shall be regarded as the absolute owner of the Note for all purposes of this ordinance. Payment of or on account of the principal of and interest on the Note shall be made only to or upon the order of thai person; the City and the Director of Finance shall not be affected bv anv notice to the contrary, bu the registration may be changed as provided in this Section. All such payments shall be valid and effectual to satisfy and discharge the City's liability upon the Note, including interest, to the extent of the amount or amounts so paid. The Note may be transferred ontv on the Note Regtsler upon presentation and surrender of the Note at the office of the Director of Finance together with an assignment signed by the registered owner or by a person legally empowered to do so in a form satisfactory to the Director of Finance. Upon transfer Ihe Director of Finance shall complete, authenticate and deliver a new Note requested bv the owner equal in the aggregate to the unmatured principal amount of Ihe Note surrendered and bearing interest at the same rate and maturing on the same date.

If manual signatures on behalf of the City are required, the Director of Finance shall undertake Ihe transfer on the Note only after the new Note is signed bv the authorized officers of the Citv. In all cases of a transferred Note, the Citv shall sign and the Director of Finance shall authenticate and deliver the Note in accordance with the provisions of this ordinance. The transfer shall be without charge to Ihe owner, except lhal the City may make a charge sufficient to reimburse It for any lax or other governmental charge required to be paid with respect to the exchange or transfer. The City may require lhal those charges, if any, be paid before Ihe procedure Is begun for the transfer. Any Note Issued upon transfer shall be a valid obligation of the City, evidencing the same debt, and entitled lo the same security and benefit under this ordinance as the Note surrendered upon that transfer.

A Note surrendered to the Director of Finance for payment, retirement, replacement or transfer shall be cancelled by the Director of Finance. Section 7. The Note Is offered for purchase by the Bond Payment Fund and then the Treasury Investment Account, and if not taken bv either, shall be sold at private sale by Ihe Director of Finance In accordance with law. The proceeds from the sale of the Note, except any premium and accrued interest, shall be paid into the proper fund and used for the purpose lor which the Note is being issued. Any portion of those proceeds representing premium and accrued Interest shall be paid into the Bond Payment Fund.

Section 8. The par value to be received from the sale of the Bonds or any renewal notes and any excess funds resulting from the Issuance of the Note shall, to the extent necessary, be used lo pay the debt charges on the Note at maturity and Is pledged for such purpose. Section 9. During Ihe years in which the Note is outstanding, there shall be levied on all taxable property In the City, in addition lo all other taxes, the same lax that would nave been levied if Ihe Bonds had been Issued without the prior issuance of Ihe Note. The tax shall be within the 10.5 mill limitation provided bv the Charter of the City, shall be and Is ordered computed, certified, levied and extended upon the lax duplicate and collected bv the same officers, In the same manner and at the same lime that taxes for general purposes for each of those years are certified, levied, extended and collected, and shall be placed before and in preference to all other Items and for the full amount thereof.

All special assessments collected tor Ihe improvement described In Section 1 end anv unexpected balance remaining in the Improvement fund after the cost and expenses of the Improvement have been paid shall be used for the payment of Ihe debt charges on the Note until paid in full. The proceeds of the tax lew shall be placed In a separate fund, which is Irrevo-cably pledged for Ihe pbv- open meeting of this Council and that all deliberations of this Council and of any of its committees that resulted those formal actions were in meetings open to the public in compliance with the law. WHEREAS, this Council has previously bv proper legislation declared the necessity of the Improvement described In Section and WHEREAS, Council, based upon actual construction bids received and estimates of other costs, has found and determinedd that the property owners' portion of the cost of the Improvement will not be less than and WHEREAS, the Director of Finance as fiscal officer of this City has certified to this Council that the estimated life or period of usefulness of the improvement described in Section 1 is at least five years, the estimated maximum maturity of the bonds described in Section 1 Is ten years, and the maximum maturity of the Notes described in Section 3, to be Issued In anticipation of the bonds, is five years; NOW, THEREFORE- BE IT ENACTED by the Council of the City of Akron, County of Summit, Ohio, two-thirds of the members elected or appointed thereto concurring, that: Section 1.
