1st fM). known as the Bitmminous Coal Act of 1U37. stipulate (wiiiin 17 fb that "the term 'Bituminous Coal includes all bituminous. eenubituniinous and sub-bitllminous coal and snail exclude llTnite. which is defined as a lisnitic coal having calorific Taiue in British thermal units of less than seven thousand six hundred per pound and having a natural moisture content in place in the mine or 30 per centum or more." and.

Whereas, it is desirable? that a method be provided whereby producers of coal may secure a iletcrmittation of their fiamg under the Bituminous Coal Act of 1937 and. if fetich coal is not bituminous, as defined in said Act. to receive a certiorate of exemption NOW. THEREFORE, 'to facilitate the administration of said Act and pursuant to its power to make and promulgate all reasonable rules anil reflations for carry-in? out the provisions of the Aot. the National Bituminous Coal Commission orders and directs: 1.

That any producer of coal may. upon application to the Commission ami iMKin presentation of proper evidence in support ot such applicat ion. if required by the Commission, a finding by the Commission as no whether or not such coal is bituminous, as defined in said Act. and if it is not bituminous, secure a certificate from the Commission showing such fact. 2.

Each su application shall be filed with the Commission in triplicate, shall duly verified by affidavit and shall include the following: (a) The nam; and post office address of the applicant and. if said applicant is not A he owner of the mining operations cjr the coal lands involved, the namle and post office address of such or owners. (b) The designation and exact location of the mi vie or mines where the coal is including the state, county and touship and producing field or fields. tc) A slaterbent showimr the ton-riage produced itfi each of the calendar years 1934. 19s5 and 1936 and the tonnage by nnjnths for the first six Bionths ol 1931.

(d) A htatisrnent showing the localities in whinh such coal is being marketed, together with the names and post offu'e addises of not less than three ot 1 persons or firms who are substantial consumers of such coal and are familiar ytith. its Qualities and characteristics.
