Surprise witness: Albert was in panties when he bit her neck Woman says she was left holding Albert's hairpiece after struggle By ANNE GEARAN Tlw Associated Press ARLINGTON, Va. A surprise witness testified Wednesday that Marv Albert, wearing white panties and a garter belt, bit her three years ago in a Dallas hotel room during a struggle that left her holding the sportscaster's hairpiece. Patricia Masden's testimony was the most shocking yet in Albert's forcible sodomy and assault trial, drawing gasps from IRS Chief apologizes for treatment FROM PAGE A1 for their problems not the agency's computer system that Michael Dolan, acting commis- sjtpher of the IRS, had earlier cited. not consumer friendly at all," said Monsignor Lawrence BaUweg, who was told he owed more than $18,000 for a minor error in filling out a form.

"If I treated people like that when I was a pastor, you can be sure my pews would be empty." Qolan released a statement at the; end of the day apologizing, saying, "No one should have to endure what these citizens de- sqribe as their experience at the hands of the tax system." Savage gives up and pays Construction contractor Tom Savage, Lewes, told the panel he had little choice but to pay up $50,000 when the IRS erroneously fingered him in an employment tax dispute involving one of his subcontractors. "Believe me, when the sources of the government are unleashed on you, you are in trouble, no matter how good your case," said Savage, who said he also paid $51,000 in legal fees and lost $600,000 in business in the ordeal. Savage said IRS agents pursued him after they couldn't collect from a subcontractor who didn't pay employment taxes. With his appeal pending, he said the agency improperly seized a check paid by Delaware to Savage for his work building a women's prison. "As much as it offended my wife and me, we chose to settle the case and permitted the IRS to keep $50,000 of the proceeds," Savage said.

"We wanted to pursue the case to the end, but to do so would have destroyed our business." Roth produced a Justice Department memo that called the IRS handling of Savage's case "wrongful." Savage said he had not seen the memo and angrily remarked, "These people knew they were acting illegally and they deliberately didn't care." Jacobs Is owed $10,000 Nancy Jacobs of Bakersfield, described a 17-year payroll tax "nightmare" involving her husband's optometry practice. The problem began when Jacobs and her husband, Dr. Frederic Jacobs, resumed his practice after a two-year break by opening a new office in Southern California in 1979. He said he applied and received a new employer identification number for payroll tax reporting, even though the IRS should have told him to use his old employer ID number. The two employer ID numbers led to accounting problems at the IRS, and in 1981, the IRS placed a lien against the Jacobs for $11,000 in unpaid payroll taxes, she said.

"After attempting to deal with the IRS, my husband and I were so intimidated that we agreed to pay the IRS $250 a week until the balance was paid," Nancy Jacobs said. "Only after you experienced what my husband and I endured would you consider paying an IRS bill that you don't owe." Four years later, she said, the IRS admitted its mistake but only after the couple's story was featured in a newspaper article. "We estimate the IRS still owes us over $10,000, if not more, plus interest, stemming from their wrongful liens, penalties and interest," she said. ALBERT spectators but no reaction from jurors. Albert is not on trial in connection with the alleged incident, but Circuit Judge Benjamin N.A.

Kendrick let her tell her story to show what prosecutors say was a pattern of conduct. Masden said she got to know Albert well during the early 1990s when he traveled with basketball's New York Knicks and she was the VIP liaison for Hyatt Hotels. She said he summoned her to his room in Dallas in 1994, saying he needed help sending a fax. When she entered Albert's room and announced her presence, she heard him say, "Come on in." "I turned around and I saw him standing there. I saw him standing there in white panties and a garter belt.

He was exposed and he was aroused," she said. She said she stood there in shock as Albert approached her and began to rub against her. "He told me he was tense and he COUNTRY MUSIC AWARDS needed some relief," Masden said. "Then he bit the back of my neck and he pushed me. He tried to push my head down to his crotch area." As she tried to push Albert off her, she said, "I went to grab his hair and his hair lifted off.

He immediately put his hands on his hair and I ran out of the room." During the testimony, the 54- year-old NBC play-by-play man leaned back in his chair and put one hand to his chin, his face impassive. His fiancee, ESPN producer Heather Faulkiner, leaned forward and gripped the back of the bench in front of her but showed no emotion. Albert's daughter, Denise, looked pained. As surprising as that encounter was, Masden said, it wasn't the first time she had been bitten by Albert. That came in 1993, when Albert invited her to a party he said, he was having with the Knicks in his Miami hotel room.

When she arrived, the room was empty. She said she waited an hour before Albert showed up, and he was alone. "We were drinking wine and talking, and he started asking me weird sexual questions," Masden said. A moment later, she said, Albert leaned over and kissed her and bit her on the lower lip. "He asked me if I was interested in a menage a trois," specifically, three-way sex with another man.

He also asked for oral sex and she refused. Then, he kissed her on the neck and the kiss turned into a bite, she said. At that point, she left. A 42-year-old woman said Albert, furious when she failed to recruit another man for a sexual threesome, threw her onto the bed in an Arlington hotel room Feb. 12, bit her severely on the back and forced her to perform oral sex on him.
