The contract contains an arbitration clause, requiring all trade disputies to be submitted to arbitration, but It is claimed that the arbitrations boards are under the domination and control of the film exchange owners and producers.

'Attorney Oliver K. Eaton, counsel for the moving picture theater owners of the Western Pennsylvania district, made his attack on-' the arbitration act, on the ground that it Usurps the power of the courts and deprives constitutional rights. NATION-WIDE ATTENTION. The trial of the case is attracting nation-wide attention. Testimony was introduced yesterday showing the United States is divided into 13 zones by the film exchanges.

In each of these zones there is a film board of trade, but these are dominated and the policies dictated by main office of the film producers in New York, it is charged. The local secretaries are appointed from the New York office. A boycott and blacklist is maintained, the plaintiffs allege. Testimony was introduced to establish that in the event an exhibitor fails to comply with the award of the arbitration board his supply of films is cut off, and that he must cease doing business as a film exhibitor. The arbitration committee, which disposes of trade complaints, is made up of three representatives from the distributors and film exchanges, three chosen from the exhibitors, and a seventh may be obtained in case there is a tie vote.

CONDEMN DECISIONS. The exhibitors are unable to secure equitable decisions, it is alleged, because of the fact that the arbitrations committee is made up of persons dominated by the film exchanges and producers. If an award is made against an exhibitor the secretary of the local film board of trade notifies all of the film exchanges and producing companies, and his supply of films is cut off, it is contended. When the name of an exhibitor appears on the list sent out by the local secretary, which is virtually a blacklist, or a boycott, service will not be rendered to him by any of the companies affiliated with the local board of trade, attorneys for the McKeesport theater men allege. The same system which is in operation in Western Pennsylvania is used in all sections of the United States, the same instructions being sent out from the main office in New York, it is charged.

CLAIM HARDSHIP. Although the local district comprises counties extending to the central part of the state, and Erie county on the north, it also embraces 26 counties in West Virginia.
