JANUARY 9, 1991 From Associated Press reports Judge Dismisses Vincent's Motion NEW YORK A federal judie denied commissioner Fay Vincent't motion to dismiss a lawsuit by New York Yankees executive vice president Leonard L. Kleinman. U.S.

District Judge Leonard B. Sand, in a two-page memorandum, decided to allow Kleinman's lawyers discovery in the case. Kleinman was blocked by Vincent from succeeding George Steinbrenner as the team's managing general partner because the commissioner was investigating Kleinman at the time. Kleinman later was cleared of any wrongdoing in the $40,000 payment to Howard Spira and is now seeking damages from Vincent. Agents To Be Retried CHICAGO Sports agents Norby Walters and Lloyd Bloom will be retried separately on charges that they used cash and violent threats to recruit college athletes as clients.

Both were found guilty in 1989 after a five-week jury trial, but the 7th Circuit U.S. Court of Appeals last September reversed their convictions on racketeering and fraud charges. The appellate court said Walters had been denied a fair trial because jurors weren't allowed to properly consider his contention that he had acted without criminal intent. Bloom was unfairly denied a request to be tried separately, the appellate court said. Walters and Bloom were originally accused of persuading college athletes to sign on as clients in violation of NCAA eligibility rules.

Agassi Fined $25,000 LONDON Andre Agassi's tempestuous relationship with the tennis establishment cost him a record $25,000 fine, but he escaped suspension from this year's four major tournaments. Agassi was fined the maximum for pulling out of the inaugural Grand Slam Cup in December, a $6 million tournament boycotted by some other top players. Warrior Defense Drops Kings By JEFF MAJESKE Pharos-Tribune Asst. Sports Editor WIN AM AC Winamac's defense was a little "de-pressed" Tuesday night, but it was still enough to leave Lewis Cass feeling blue. Winamac didn't use its usual full-court press until the fourth quarter, but still shot out to a 17-4 advantage in the first quarter, and that was enough to sink the Kings, 52-39.

Winamac remains unbeaten at 14-0. Lewis Cass drops to 10-3. "About the last two or three games we've played, we've been getting in early foul trouble, so we abandoned the press and just played half-court man to man," Winamac coach Jim Swaney said. That defense, plus some antsi- ness on Cass' part, helped the Warriors grab a 13-3 lead halfway through the first period as the Kings missed their first seven shots. "We haven't played a team that plays the passing lanes as well as they do, and we better learn to deal with it real quick," Cass coach Steve Ford said.

"Coupled with their hard defense, we made some mental errors." The Kings rebounded and played the Warriors even the rest of the way but couldn't overcome Winamac's quick start. "I think that those first four minutes or so of the game were our best of the season as far as defense and contesting passes," Swaney said. "I also thought we did a good job blocking out, which is something we've been working hard on. Those things allowed us to get a nice lead, which against a team like this is what you have to do." Once the Warriors had their lead, they weren't about to let the taller Kings back in the game. Winamac ran a patient halfcourt offense for much of the remainder of the contest, eating up time while looking for layups.

Eagles Assistant Replaces Ryan As Coach PHILADELPHIA (AP) Richie Kotite took the elevator to the Philadelphia Eagles' front office expecting to be fired and came down as the successor to coach Buddy Ryan. In a whirlwind performance Tuesday, Eagles owner Norman Braman fired Ryan and some six hours later replaced him with Kotite, the ousted coach's offensive coordinator. Kotite, 48, who at this time last year was an unemployed former offensive coordinator of the New York Richie Kotite Promoted Jets, was given a three-year contract, Braman made it plain what he expected. "It is time to stop being a bridesmaid and become a bride," said Braman, whose team has reached the NFL playoffs three straight years and each time has been eliminated in the first round. "We hope we made the moves today that will get us to the promised land (the Super Bowl)." Braman said he fired the controversial Ryan because he "felt the team had not reached the level that we could progress into the future." He said he told Ryan someone else was needed to taice the next step.

Why Kotite? Braman said he and club president Harry Gamble wanted to stay within the organization, and narrowed the field to Kotite and defensive coordinator Jeff Fisher. "We feel we have the nucleus of a fine football team," Braman told a news conference. "We didn't want to bring in someone who would have to start from scratch with new assistants, with an individual who basically was not familiar with the characteristics of Buddy Ryan our players or with our systems." Dismissed Kotite thanked Braman for "a once in a lifetime "I've been a coach since 1973, and since 1977 in the NFL. This is an outstanding football team, and for Mr, Braman to give an assistant an opportunity to be coach means an awful lot. It's kind of overwhelming," he said.

Earlier Tuesday, Braman went to Ryan's Veterans Stadium office and told the coach his five-year regime was over. "This obviously is not an easy decision," Braman said. "After waiting this long, it would really have been hard to take a disappointment for the third time." Perry said. "The first time 1 can accept.

The second time I was disappointed. But I feel wonderful now." Carew. who won seven American League batting titles, didn't have to wait at all and made it to Cooperstown on his first try. He is the 22nd player to be voted in the first year of eligibility. F.

Jenkins "I did positive things on the Held, positive things off the field, in the community," Carew said. "1 gave a lot of myself off the field." In order to gain election, a player must appear on 75 percent of the ballots cast by 10-year members of the Baseball Writers Association of America, and Jenkins just made it. A total of 443 members of the BB- WAA cast ballots this year, meaning 333 votes were needed for election. Jenkins had 334 votes for 75.3 percent. Carew made it by a more comfortable margin with 401 votes (90.5 percent) and Perry had 342 votes (77.2).

"I started not to have a group of friends over this year, but my son Jack insisted, and I'm glad he did," Perry said. Rollie Fingers, the all-time saves leader, had some friends at his house and a bottle of champagne on ice. His friends went home unhappy and he had to put the bottle away. "Probably the one thing that kept me from getting in was that Gaylord Perry and Ferguson Jenkins have been on the ballot the last three years, and with the numbers they put up it's tough to keep those guys out for very long," Fingers said. "1 might have to wait a couple of years." Fingers received 291 votes (65.6 percent) and Jim Bunning.
