Spokesmen for prosecutors in Monmouth and Ocean counties said yesterday that they would not comment because they had not seen Garbko's site or its links.

First Assistant Monmouth County Prosecutor Alton D. Kenney did, however, warn people about online solicitations. "Anyone who would even consider participating in this site would hopefully look at the motivation for it, especially if there is a connection between this site and the (Omega) site," he said. Garbko said he was in no way belittling the tragedy that befell the Werners, whose son was killed Sept. 27.

But he chastised Monmouth County prosecutors who involved Manzie in the investigation of Stephen Philip Simmons. Authorities believe Simmons, 43, of Holbrook, Long Island, and Manzie had a least four sexual encounters. "Eddie Werner, the poor little kid, who paid with his life for the 'system malfunction' is a victim. But he is not the only (one). The most beneficial (thing) for society (to do) is to take the lesson and improve the system, not to destroy another boy," Garbko said.

Ocean County Prosecutor E. David Millard is seeking to try Manzie as an adult, which would subject the teen to harsher penalties, including life in prison. The site, titled "New Jersey Murder in Memoriam," states the cause of the murder could be the people who did not get Manzie the help he needed and the "arrogance of the grown-ups and their alleged knowledge of how a maturing guy should live and who he should make friendship with." Garbko said he had been in contact with the Manzie family and left a message for them yesterday to inform them he was speaking about their son.

Mercer County Prosecutor Maryann K. Bielamowicz said yesterday that the skull discovered by hunters on Nov. 28 was that of Gina Marie Gallo.

Dr. Haskell Askin made the identification, Bielamowicz said. Hamilton Township police informed Gallo's parents who long had contended their daughter was the victim of foul play on Wednesday, according to the Times of Trenton and the Associated PressJ The published reports also indicate the parents, Pat and Polly Gallo, live in Jackson Township but that could not be confirmed 1 Gallo, 22, worked as a night clerk at the Laurel Notch Motel in Bordentown Township and shared a room there with her boyfriend when she vanished on Nov. 16, 1981. The boyfriend told police he last saw her setting out to hitchhike to the Quakerbridge Mall in Lawrence Township.

Rocco said he believes a bill applying only to public schools can withstand a constitutional challenge. "Fortunately for the law enforcement people and for the family, there was sufficient dental evidence in order to accomplish a dental identification without question. It doesn't always work out that way," he said. Askin has had Gallo's records since her disappearance. Investigators continue to search the surrounding area for the rest of Gallo's remains. Police could not give a cause of death.

Although Gallo has been miss-, ing for 16 years, the case never really faded from view, said Sgt. Al DellaFave, a spokesman for i the state police. In November 1993, a state police inmate told authorities he helped bury the body of a young woman in Hamilton in 1981, but investigators found nothing. In 1994, authorities searched a remote area of Kingwood Township after art informant told them that Gallo's remains might found in an area called "Devil's Tea Table," a large wooded area noted for its 40-foot-high cliffs and rugged terrain DellaFave said no remains were discovered in that area but tips continued to be received. In September 1996, the Gallo family began offering a $5,000 re-; ward for information.

DellaFave said the woman's boyfriend, Ed Jones, was the last person to see her alive. "That would make him one of the prime people we would question," he said. Werner, Assemblyman John A. Rocco, R-Cam-den, has introduced legislation prohibiting public schools from sponsoring door-to-door fund-raising activities. Concerns about the safety of door-to-door solicitations were raised after Werner, 11, of Jackson Township, disappeared on Sept. 27 while selling gift wrap and candy in his neighborhood. Rocco said fund-raising is a huge industry, with 1.2 million students taking part, but has become an unsafe practice in recent years.
