Kennedy, R-Monmoulh, voted with the Democrats yesterday on the only issue that split the Assembly on the first day of the new session. While all other Republi cans abstained, Kennedy supported a majority party resolution declaring John a Middlesex Democrat, qualified to continue serving in the Assembly.

Froude, who was re-elected in November, is an assistant professor at Kean State Col lege. His right to keep his Assembly seat has been called into question as a ruling by Atty. Gen. William F. Hyland regarding a prospective candidate for the Legislature who also held a state college job.

The ruling against a state college faculty member serving in the Legislature was based on the constitu-. tional prohibition against legislators also holding other state office. Assembly Democrats asserted that the Constitution gives each house of the Legislature the power to judge the qualifications of its own members. The resolution was approved 48 to 0. There are 49 Democrats and 31 Republicans in the new Assembly.
