Investigators revealed yesterday they are questioning officials of the Roberts Brothers Top Three Circus in Lebanon, about last Thursday's fatal accident during a performance in Washington Township. The victim, Jerome J. Vaccarezza, was buried yesT terday as more than 300 mourners gathered. The boy bled to death after the 175-pound leopard lashed out at him when he got to close during a performance. Morris County Prosecutor Peter Manahan has said he would not file criminal negligence charges against the circus or the leopard's owner.

The USDA said it could revoke the licenses of both if negligence is found. The investigation is expected to continue for about a week. A report will be filed with the department's animal welfare program. "We could also have the animal killed if we find a need for that. I can't comment on what will happen, however, until all the evidence is in," said Carmelo Gonzalez for the USDA regional office in Albany, N.Y.

But MYSTIC, Conn. (AP) -Aquarium officials struggled yesterday to keep an ailing, 600-pound pilot whale alive after it was flown to Mystic from Atlantic City. r. A spokeswoman for Mystic Marinelife Aquarium said staff members spent the day in the large tank, "walking" whale, keeping its blow hole above water so it n't drown. The whale is stricken with i pneumonia and possible injury to its central nervous system.

It received an anti- bfotic inoculation yesterday, and officials were awaiting the results of a series of laboratory tests. Laura Kezer, a spokes- woman, said the whale had eaten several pounds of fish since its arrival, which she said was a good sign. The olive-black male, 1 which beached itself in Wild-wood May 26, was airlifted from the Marine Mammal Stranding Center in Atlantic City to Trumbull Airport in Groton, and then taken by National Guard truck to the aquarium where it arrived at about 3 a.m. "It seems to have some very strange swimming habits," Ms. Kezer said.

"But we haven't had enough time to determine whether this is a problem with its ability to swim or if it's a behavioral thing. "Someone who saw it bumping into the sides of the tank said the whale had the turning radius of a Mack she said with a laugh. The whale, which is be-lieved to be 3 or 4 years old, is in the same tank with another of the aquarium's "rescue" projects, the only known Commerson's dolphin in captivity. The rare, piebald (spotted) dolphin has been here for nearly six months. It was seized after being shipped illegally into the United States en route from Argentina to Japan.

"We're very pressed for room here," Ms. Kezer said. "The two animals seemed to get along." The New Jersey center had nursed the whale through several brushes with death in the last 16 days. Reldan Jail Mate Testifies HACKENSACK (AP) A paroled Rahway State Prison convict testified yesterday that Robert Reldan confided toThim in 1976 it was an accident the bodies of two women he is alleged to have killed were found.

Allison Williams of Pleas-antville, who agreed to testify against Reldan in exchange for a reduced prison term, said the conversation took place while the two were in the prison. Reldan, 39, is on trial in Superior Court here on he abducted and slew Susan Heynes, 28, of Haworth, and Susan Reeve, 22, of Demarest. Their bodies were found in late October 1975, in separate wooded areas of Rockland County, Y. Williams told the jury Reldan complained about New Jersey exercising jurisdiction over the murder case. "What was the use of taking the bodies up there," Reldan said, according to Williams.

Court Upheld In Abortions TRENTON (AP) Non-sectarian, non-profit hosp: tals in New Jersey may not deny services to women seeking abortions in the first three months of pregnancy, a state appeals court ruled yesterday. The Appellate Division of Superior Court said recent U.S.

Supreme Court decisions on abortion do not invalidate a state court decision that New Jersey's "conscience law" does not apply to non-sectarian, nonprofit hospitals. Under the state's "conscience law," hospitals are permitted to refuse services or procedures to women seeking abortions. The Appellate Division ruled in a suit brought by Bridgeton Hospital Associa tion Inc. The hospital association contended a trilogy of cases decided on June 20, 1977, by the U.S. Supreme Court upheld the right of non-sectari ian, non-profit hospitals to deny abortion services to women.

The Appellate Division said, however, the federal justices held only that states are not required to financially assist in the exercise of the right to an abortion. The prohibition against states directly hindering the exercise of that right was preserved, the Appellate Division said.
