Double Fatality Attends Burning of the Jewell Lutheran College. Webster City, Dec. 6:30 o'clock yesterday morning the main college building of the Jewell Lutheran college at Jewell Junction burned to the ground, destroying the lives of two students who were sleeping on one of the upper floors. The loss is about $25,000. The cause of the fire unknown.

The dead are: Berten Malang, son of Ole Malang, residing south of Williams, In this county, and Julius Petersen, of Red Wing, Minn. Nothing was Baved from the burning building. When the fire was discovered it had gained such big headway that the facilities at hand were insufficient The structure was outside the fire limits of Jewell, and the fire company could do but little in the way of giving aid. Great crowds congregated, and many of the students, bent upon saving as many of their personal belongings as possible, rushed into the doomed structure. Not a few of them met with very narrow escapes.

The building was of brick, but the blaze had gained such headway when discovered that absolutely no control could be gained over It. It burdend rapidly and slowly tumbled to the ground. It was when it was seen that the building was surely "doomed that some of the students would be unable to get out. Nothing certain of this was known, however, until after the lire, when the professors checked up the list of those enrolled. It was then discovered that Malang was missing.

As-soon as the hot ruins could be reached, a search for him was Instituted and his charred remains were found beneath some of the timbers of the destroyed building. Later it was discovered that Julius Peterson, a student from Red Wing, was also missing. His body was not found until late yesteday afternoon. The Jewell Lutheran college was erected in 1892 by the Iowa district of The Hague synod of the Lutheran Its cost was $22,000. The furniture was valued at.about $5,000.

It was insured for but $4,000, which will make the loss a hard one for the ihurch. DIVORCE LAWS HIT. Judge Howe Decides Alderman Fagen Is not Legally Separated. Clarke, of Adel, who, if he lives, will be the speaker of the house in the Thirtieth General Assembly, is still in the prime of life, admitting the passage of fifty-one years. He is a practicing attorney in his city. He has already been a member of two general assemblies, the Twenty-eight and Twenty-ninth. Mr. Clarke was born in Shelby county, Indiana, October 24, 1852.

His parents moved to Iowa in 1856, and took up a residence on a farm near Drakeville In Davis county, a town named after the father of the late General F. M. Drake. He was anxious to secure an education and graduated at Oskalooosa college and afterwards from the law late Alderman Fagen was not legally divorced from Mrs. Fagen, nee Lily Bowen, who sued for her dower rights in the Fagen homestead.

Fagen married Lily Bowen secretly. They lived together but a short time, when he went to Dakota and procured a divorce under the Dakota iaws. we axterwards died. Mrs. Fagen sued for her dower rights in the homestead and the heirs resisted on the grounds that she was divorced from her husband at the time of his death.

court holds that, under the evidence, Fagen went to Dakota for tha purpose of procuring a divorce and for no other purpose. The decree is therefore held null and void. COLORED TROOPS AT FORT. Companies and of Twenty-fifth Infantry at Des Moines. Des Moines, Dec.

and of the Twenty-fifth U. 3. infantry arrived yesterday morning to take temporary residence at the army post. They come from Fort Niobrara, Neb. The troops consist of colored men.

They will remain at Fort Des Moines for about two months, or until arrival af the Eleventh U. S. Cavalry from the Philippines, and will then be transferred to some other point. J. D.

Des Moines, Dec. his biennial report submitted yesterday to the governor, Richard C. Barrett, state superintendent of public instruction, makes an Important "recommendation for the establishment of free publlo high schools through state aid. The recommendation is-of the greater importance because of the implied opposition expressed recently at the meeting of the secondary school men in Des Moiues to such a measure. The measure will probably be taken up by the legislature.

The plan which Superintendent Barrett urges is similar to that In vogue in Minnesota, where it has been a pronounced, success, where the necessity of paying tuition by country boys and girls in high schools is obviated by throwing open the city schools to them. To meet the extra expense incurred, the state would pay the schools a stated sum annually, thus making it possible for every country boy and girl to have a high school education free of charge. He says the making of better arrangements for the advanced education of pupils residing beyond the city and town districts is absolutely imperative, and concerning the free high school, says: "Among the plans proposed to improve the school system of the state and to provide equal school privileges for country boys and girls, Is for the state to appropriate to certaiif. high schools, which meet such requirements as may be fixed by law, or the body governing the schools designated, a reasonable sum to pay expenses incurred by increased attendance. "The theory advanced by those who look with favor upon the inauguration of the system is that the property of the state should be taxed to educate the children of the state.

The fact that the state taxes itself to support higher Institutions of learning, where a comparatively small number is given instruction, is cited as an illustration of the state's wisdom, and it is urged that the time has come for the state, to assist In providing high school advantages for the masses." Barn and Seventeen Cars Burned. Muscatine, Dec. car barn of the Citizens' Railway and Light company was destroyed by fire of an unknown origin yesterday morning. misunderstanding is responsible for the swamp land case which is agitating all Webster county and which is now being considered by the officers of the United States land office in this city. When the supervisors of Webster county waived the county's claim on the lands now in question, they thought they were simply waiving the identity rights upon the properties, as upon 165 other tracts, which were passed upon at the same time. The whole difficulty arose out of the fact that the title of the fourteen tracts over which dispute had arisen had never passed from the United States government, but had been granted by the state to the county and by the county, disposed of to priyate parties, under the assumption that it would some day pass. It has deve oped during the hearing that the claim of William Moses, who lays claim to the title of the land, was filed over two months before S. J.

Bennett, thei county's agent, submitted his report, and before it was accepted by ti.o board of supervisors.
