Color coordinated patterned Opinion NEW BRUNSWICK dlesex County District Court Judge John E. Bachman will Issue a formal, written opinion on an "unusual" case involving nine Monroe Township residents convicted of trespassing at the Kossmoor closed retirement community. The defendants, calling themselves "the Rossmoor Nine" appealed the Feb. 19 municipal court conviction to Judge Bachman, who heard final arguments and testimony in the case yesterday. He said he wanted to review the matter and issue a formal opinion "because of the unusual nature of the case." The nine contend that they exercised their constitutional rights of free speech and freedom to petition when they went to Rossmoor to gather signatures for a change in government referendum.

Edward Podolesky, a special deputy assistant attorney general assigned to the prosecutor's office, argued that when the nine went through the main gate at Rossmoor a "no trespassing" sign was posted and after they were told they couldn't petition door to door, Rossmoor officials offered them facilities at the community's club house to collect signatures for the government change referendum set for April 6.
