State against tho course hi has taken and continues to take in I the matter of refugee Taylor who Is I a fugitive from Kentucky Justice Gov Durbin not only persists in ulf defiance of the plain mandate of the law especially made and provided for such cases but outrages every prln clple of right and Justice by his con tlnuapcc of a policy which renders Inoperative oue of the strongest clauses of our great Constitution Paragraph 2 of Section II of the Fourth Article of the Federal Con stltution says A person charged in any State with treason felony or other crime who hall flee from justice and be found In another State chill on demand of the esecutlre authority of the State from which be fled be delivered up to be reo moved to the State having jurisdiction of the crime Upon two separate and distinct occasions invested with all the authorIty which the act requires Gov Beck ham has demanded of Gov Durbln that he deliver up Taylor to the proper Kentucky authorities that he might be tried upon the charge of complicity in the assassination ol Gov Goebel Each time the sacred writ was Ignored Gov Durbins excuse for his refusal to grant the demands of the writ was that he did not believe that Taylor woulfl get a fair trial In Kentucky and furthermore that he did not believe he was guilty anyhow Nevertheless this provision of the Constitution Is mandatory It is the duty of the Governor of a State where felons and traitors seek refuge to give them up It is not for him to decide whether they are guilty or Innocent His opinion In the matter is not asked for nor expected The Constitution gives him no jurisdiction over the question which must be determined in the State where the crime was committed Recently the Rockport Indiana Jkmocrut contained a strong editorIal censuring Gov Durblns action In the Taylor matter and excoriating him for hIs refusal to obey the plain edict of the Constitution under which he lives and Is supposed to conduct the affairs of his once Replying to that editorial and classing the editor of the Jkmncrut with the Goebelltes of Kentucky the Rockport Indiana Joumul says They know Governor Taylor had nothing to do with the killing of the unprincipled scoundrel who was trying to rob him of his office and all this hue and cry about the assassination by Republicans Is made and kept up only to draw attention from the cuticdness of Goebel ands his baud of anarchists And so the Democrats of Kentucky know that Taylor had mlhiny to do with the killing of Governor Goebel do they How many of them know It or even think ItV Is there a single Kentucky Democrat who will come out over his own signature and say any such thing We hardly think so If the editor of the Journal Is a conscientious and fairminded man and not knowing him we cannot aver otherwise and will come to Kentucky and Investigate Into the assassination of Wm Goebel wa believe he will have every reason to lnote that Taylor did have something to do with the killing of Mr Goebel We will not ask him to take the word of Democrats for it Wo will refer hIm to the sworn testimony of men high up in tho councils and esteem of the Re publican party of Kentucky These men say that Taylor knew of every murderous detail Then wo will ask him to go to the plain history of events In our Stato at the time of Mr Goebels murder and see If ho can glean from them anything that points to Taylor us having any pre Ious knowledge of or anything to do with Win Goebelti taking off Who brought the mountain feudlstH to Frankfort a thousand strong Who Issued orders fur soldiers who the feudists section Who gave orders Immediately after Mr Gocbels assassination forbidding that any search bo made around the Capl tol buildings for the assassins Who suspended the writ of IIIIIJCIll mrjnu In violation of Section II 1 of the First Article of the Constitution which declares this writ Ahull not be suspended save In cases of Invasion or rebellIon neither of which conditions existed of Democrats and the possible addition to their ranks of a few voters who value pelf more than party If by any ruse or decep Lion they can get a few hundred Democrats to forsake their party and vote for Belknap tliey hope to supplement this acquisition to party strength with whatever their barrel of boodle will buy No true Democrat will be deceived by these tactics There bless reason for a Democrat to vote against his partys nominees this year than ever before In fact there Is no reason whatever Democrats are always Independentsometimes too much sobut there are no Independent voters In the ranks this year GovDunmNof Indlanahas written an article entitled The Mob and the Law published in the Independent and President Roosevelt has come out over his own signature and praised Durbln for the part he took In the recent riot at Evansville The purpose Roosevelts effusion Is well understood as an open bid for the negro vote but what a travesty upon Jus Lice and duty is it fur a man like Durbin who defies the great Constltu Lion to undertake to write upon the province of The Law The man who purposely Ignores the highest edict of law Is hardly good authority upon the lesser forms of popular Jurisprudence THE word Independent sometimes has personal charm about it that is alluring to some people It carries with It the Idea that practic ing thlssplrlt they are more the possessors Consternation TO INFLUENCE counT Of APPEAL ThA strongest most damaging and conclusive evidence of the guilt of Caleb Powers of complicity in the Goebe murder conspircy which has heen produced in court in the three yeas since the crime was committed fell from the lips of Henry YonUey 01 the witness stand last week and was supported by a document signed by the defendant himself The story and dock ment explaIn why Powers for two years past has been urging that the Republican party in Kentucky is on trial in his person As it was unfolded I to the jury the prisoner lost the smile which at times in this trial has crowned his face and an ashen hue took its place He was more vlslblj affected than he has been at any time since the trial was begun and did not completely recover himself before ad journment of court The story told by Yontsey and sup ported by the document with Powers signature attached Is that in the Louisville jail on January 28 1901 he signed an affidavit to be used only for the purpose of influencing Repub licans of the Court of Appeals to reverse the Scott Circuit Court and grant Powers a new trial In that affidavit he made the false statement that he knew of nothing ot an incriminating nature against Powers but in banding it to the defendant he Yontsey required him tc sign a statement that he waived the truth or falsity of the affidavit executed by Youtsey and promised never tc make it public or present it in any court and agreed to return it tc Yontsey within fifteen days that i it might be destroyed This written agreement signed by Powers was filed by Yonteey in support of his statements regarding it and was made a part of the evidence in the case and read to the jury The document is in full ae follows TIlE AGREEMENT 4 This agreement made and entered into this 28th day of January 1901 by and between Caleb Powers now under conviction as a conspirator and Henry Youtsey under conviction as a principal in the murder of Gov Goebel Withesseth that for a pnrposeonly of enabling the said Powers to clear himself of all connection with said murder the said Yontsey agrees to and does sign and swear to the following affidavit waving its truth or falsity State of Kentucky County of Jeffer son SSThe want Henry Yont sey states he is now confined in the jail of Jefferson county Ky under conviction as a principal charged with the crime of killing Senator William Goo bel In Frankfort in January 1000 that Caleb Powers has been charged and convicted of the crime of being an accessory Ibefore the fact to said murder of said Goebel This affiant further states that his affidavit is made voluntarily and of his own free will and ac cord and that one purpose thereof is to refute and contradict the rumors and publications which have from time to time been current that this affiant knew or knows facts tending to connect the said Powers with the commission of saId murder This affiant now states that never at any time did he nor does he now know of any fact or circumstance which eIther directly of indirectly remotely or otherwise connected or connects the said Caleb Powers with the killing or injury of said Goebel or any knowledge thereof that so far as this affiant knows said Caleb Powers is absolutely innocent of any kuowl edge that the murder or any harm to the said Goebel was contemplated and that this affiant knows of no fact nor has he any information from any source that said Powers had or has any knowledge or intimation of who fired tho shot that killed said Geobel nor when said shot was fired Affiant further states that this affida pit is based upon a strong Impression and belief in his mind that said Pow ers is innocent of the crime of which he is charged and makes the affidavit in the interest of justice It is agreed and stipulated that the affidavit of which above is a copy shall not be published in any way nor used in court and that the same shall be reo turned to the said Youtsey by February 16 1001 also the paper signed by said YonUey at Frankfort and witnessed by John Cox Witness our hands this day and date above written OALKII POWERS SAYS QUPFV WAS MEDIATOR The affidavit which Youtsey made wan he says asked for by Powers at the instance of Estill Gnffy of Lonla ville a Federal official and the oldest Hon of the then Chief Justice Gnffy lute of Frankfort but now of Indiana Youtsey says that Guffy cameo the jail to see Powers so Powers Informed him and told him that if he could secure such an affidavit from him Yontsey that he Powers could secure from the Appellate Court a reversal of the life sentence and a new trial The witness refused for a long time to give it and did BO only upon suggestion of his hall brother Crawford of Newport and upon the signing of the agreement by Powers
