ST. LOUIS POST-DISPATCH 4B MONDAY, NOVEMBER 8, 1993 Suit Over 4Rap Rewrite' Goes To High Court public row with law officers over censorship. At issue here is the concept of "fair use" of a copyright. Lawyers on both sides want to establish whether someone may freely borrow a portion of an artistic work for parody or whether the copyright owner controls such usage. Lower courts have split on the issue.

Backers of 2 Live Crew say that a ruling against them would severely curtail the art of satire. Russell, the political satirist, notes: "If you wanted to do a parody, it would be like the underground performances behind the Iron Curtain. Put a guard at the door." But songwriters say an adverse ruling would limit their ability to make money from their work. Hit songs like "Oh, Pretty Woman" have a financial life long after they slip down the charts. Publishers like Acuff-Rose vigorously guard the use of copyrights.

In neither court papers nor interviews would they reveal what the song brings in each year. "That song is responsible for most of my income," Dees said, allowing only that he makes over $100,000 a year. Van Halen's heavy metal version and the Julia Roberts movie "Pretty Woman" were big moneymakers for Dees and Acuff-Rose. Acuff-Rose refused permission. 2 Live Crew went ahead anyway, borrowing the song's trademark guitar riff for verses that taunt a "big hairy woman," a "bald-headed woman" and a "two-timin' woman." The publishers sued, claiming copyright infringement.

Luther Campbell, leader of 2 Live Crew, defends his actions. "You're not doing anything to harm the copyright. You're just having fun. I've had it done to myself a few times on 'Saturday Night They imitated me and had fun with my records." Legal challenges are nothing new to 2 Live Crew. Their album "As Nasty As They Wanna Be" started a WASHINGTON (AP) William Dees, who wrote the flirtatious "Oh, Pretty Woman" with the late singer Roy Orbison, detested 2 Live Crew's ribald rewrite of the 1964 rock classic.

"It's like if someone asks you if they could use the car," he said. "We said no, but they take it and paint it all different colors." A dispute over the rap remake has reached the U.S. Supreme Court and turned into a test of copyright law's strength and the boundaries of satire. Dees, a Missourian, lives in tiny town of Lampe, (population 75), near Table Rock Lake. Dolly Parton, Michael Jackson, comedian Mark Russell and the publishers of Mad Magazine are among those who have filed briefs with the court on both sides of the case, which will be argued Tuesday.

"There's plenty of money involved," said lawyer Stephen Kaye, who represents the estates of songwriters Irving Berlin, George Gershwin, Cole Porter and others battling 2 Live Crew. The fight began in 1989, when the raunchy rappers asked Acuff-Rose Music the Nashville music publisher that owns the copyright to the song, for permission to change some lyrics. Straight remakes are no problem after a song is recorded, as long as writers and publishers are credited and receive royalties. But rewrites fall into murkier legal territory. The St. Louis Minority Contractors Association and the St. Louis Minority Workers Association sued the St. Louis Regional and Sports Complex Authority on Friday in U.S.

District Court. The groups' attorney, Eric Vickers, says the groups will seek a federal court order to halt construction if the Sports Authority fails to: struction work force. It also alleges that the authority acquiesced "to the racially discriminatory practices of the trade unions in St. Louis." In a prepared statement, Vickers said the two groups would "file an injunction action to halt the construction of the project" if the stadium authority "does not comply with these terms within 10 days." Sports Authority director Larry Ackley said Friday that he could not comment on the suit's specifics because he had not seen it. Ackley said there was no merit to allegations of discrimination, "nothing that would warrant a lawsuit." Daniel H. Hundley, a retired Army colonel and professor of engineering, economics and industrial relations at Washington University. He retired from the university in 1966 and died in 1988. Hundley of University City, and several nieces and nephews. Virginia Black Hundley, a longtime St. Louis area volunteer, died Saturday (Nov. 6, 1993) at the Marie De-Villa Retirement Center in Ballwin after a brief illness. She was 88.

Mrs. Hundley, of University City, was a native of St. Louis and a 1925 graduate of Washington University. She was active for more than 50 years in the Jefferson chapter of the Daughters of the American Revolution in St. Louis.

Mrs. Hundley was also one of the oldest members of the St. Louis Women's Club, a social and charitable organization in which she was active for about 50 years. Mrs. Hundley also donated both her time and money to the Salvation Army for many years.

Louis, Mo. 63108. A. Gene Martin, a St. Louis restaurateur and tavern owner for parts of five decades, died Saturday (Nov.

6, 1993) of a heart ailment at his home in St. Louis. He was 85. Mr. Martin was born in Chicago.

He attended the University of Illinois and rode the rails before going into business in St. Louis with his uncle, Andrew Fretz. During World War II, he served in the Navy in Key West, Fla. After the war, he owned two taverns in St. Louis, The Midget and the 34 Club.

Later, from the late 1940s into the 1960s, he owned the Stymie Club, a popular restaurant and supper club in University City. KUNTZ, HELEN F.
