A-4 Pittsburgh Press, March 22, 1 980 Marital Battle Goes To Court Rosenbergs came to light in 1978 during a Public Utility Commission hearing. Mrs. Rosenberg, who has continued to live in the mansion since her 1976 divorce, owed almost $7,000 in gas bills. She told the PUC that she couldn't pay Peoples Natural Gas Co. because had no other money "other than" $5,000 in support payments from her former husband.

Rosenberg replied at the time that he had asked Peoples to shut off the gas because she had promised in the property settlement to vacate the home so it could be sold. Rosenberg also said he was paying the mortgage and taxes oh the mansion in addition to the support payments and that she should have had enough money to pay the gas bill. Peoples filed a judgment against Mrs. Rosenberg last September for failure to pay the delinquent account. Greenfield said his client has "made arrangements" to settle her debt with the gas company.

His ex-wife then retaliated by saying that she was entitled to a jury trial in his quest for money damages. When Strassburger agreed with her, Rosenberg appealed to the state Superior Court. That appellate court yesterday ruled in favor of the former husband. The Superior Court reminded Mrs. Rosenberg that she intially set out on a legal route that requires a judge to decide the issues.

Once that course was set, she couldn't ask for a jury trial, the court ruled. So it sent the case back to Strassburger. Meanwhile, the Family Division jurist already had worked out the three-day session with attorney Stanley" Greenfield, who represents Mrs. Rosenberg, and attorney David Gordon Fisher, who represents Rosenberg. Greenfield disclosed the arangement when asked to comment on the Superior Court decision.

The bitter dispute between the By LAWRENCE WALSH Theodora Rosenberg and her former husband, David Rosenberg, hope to finally resolve their long-standing domestic dispute during an unusual three-day courtroom confrontation before Common Pleas Judge Gene Strassburger. Although similar proceedings rarely take more than a day, the April 29 through May 1 session was scheduled to settle, "once and for all," the controversey surrounding the couple's property settlement, support payments for a child living with Mrs. Rosenberg and the custody of the child. When Mrs. Rosenberg sued her ex-mate several years ago for allegedly not living up to the terms of their hefty property settlement, including the disposition of a 23-room Squirrel Hill mansion valued at $450,000, Rosenberg coontersued and asked for $375,000 in damages.

District Real Estate Transfers Listed Bloodhound Helps Catch 3 Escapees MONTOUR, Pa. (UPI) A persistent police chief using a borrowed bloodhound tracked down and captured three fugitives from "the Rockview State Prison near this Columbia County township, less than a day after they escaped during a work detail. Montour Police Chief Robert Leighow, one of about 30 lawmen giving chase -with the help of "Fanny" the bloodhound found the unarmed trio hiding under logs yesterday afternoon near a house at nearby Hemlock that they allegedly had tried to break into with an ax. Police thought they were in the area, 70 miles from the prison in Bellefonte, when they found an abandoned stolen vehicle. Leighow said Montour and Hemlock police frequently borrow the dog, owned by James Shaffer, of nearby Dewart.

The inmates were identified as: Matthew Smith, 21, of the Beechview section of Pittsburgh, who was serving four to 10 years for a burglary conviction; Samuel J. Santillo, 26, of the Brookline section of Pittsburgh, serving seven to 15 years for robbery, conspiracy and aggravated assault; and Paul Gulich, 23, of Lehigh County, doing two to four years, 11 months for terroristic threats, robbery, reckless endangerment and involuntary deviate sexual intercourse. Gerald Wilson, deputy superintendent of the Centre County facility, said the three had been working inside the compound Thursday, but failed to show up for a head count at 6 p.m. The inmates apparently escaped by climbing a fence around the minimum-security facility. The three face burglary charges in Montour for the alleged attempted break-in.

Wilson said they also will face escape charges in Bellefonte. Syria Warning Aired DOHA, Qatar (UPI) A senior Palestine Liberation Organization official, Salah Khalaf, has warned that Syria is in danger of breaking apart as a result of the same kind of sectarian civil war that divided Lebanon, the Kuwaiti News Agency reported today. Man Held For Burying Girl Vital Statistics GALVESTON, Texas (UPI) Police have charged a transient in the abduction of an 8-year-old girl who was buried alive overnight under a pile of rocks on a beach 3 feet from the water's edge. Police Chief Ernest Galvan said Jeffery Steven Goldberg, 21, also known as Steve Cummings, was charged with kidnapping and attempted murder. He was being held in lieu of bonds totaling $100,000. Goldberg, who listed previous residences in California, Denver and Chicago, was one of three transients picked up by police Thursday after the discov ery of the child, whose identity was withheld by police. "We're very fortunate she didn't suffocate because of the weight of the rocks on her chest," said Police Sgt.

Howard Picard. "When they uncovered that little girl, she had indentions all over her from those rocks. Some were the size of grapefruits but some were half as big as a table and weighed 35 or 40 pounds." He said authorities were not sure whether the child was sexually molested. Officers hoped to question her at John Sealy Hospital when doctors say she is strong enough to be interviewed.
