In a David-and-Goliath battle over fast food, McDonald's lost a lawsuit Wednesday against a kiosk owner who sells burgers under the name McAllan. McDonald's earlier this year sued Allan Bjerrum Pedersen, accusing him of violating its trademark by using the "Mc" prefix. But a court in Silkeborg, Denmark, ruled the stand's name and logo are different enough that there is no trademark violation. Pedersen has sold hot dogs and burgers from a one-man stand under the name McAUari since 1984. His stand, not far from a McDonald's, uses a logo different in shape, size and color from the burger chain's "Golden Arches." The fast food feud caught attention throughout Denmark, even prompting one supporter of Pedersen to place a U.S. Civil War-era cannon next to McAllan's stand and point it toward the nearby McDonald's restaurant. McDonald's, which has 35 restaurants in Denmark, wanted the use of "McAllan" banned because "a commercial use of our trademark 'Mc' could water it down," said spokeswoman Use Nielsen. Pedersen said he called the business McAllan after a friend gave him a bottle of McAllan Scotch. The whisky maker never complained, he said. reduce the value of the total offer by about $290 million. Kemper has not responded to the revised offer. "Our board will review it in due course," said spokesman Bob Schuerings, who declined to comment on possible new suitors. Jim Rosensteele, a Conseco spokesman, said Wednesday the company still believes its offer to Kemper is best for both companies and "we're waiting to hear from Kemper." Conseco is looking to expand Kemper's mutual fund and investment banking businesses while liquidating the Dlinois company's real estate holdings. Other companies have expressed interest only in Kemper's insurance operations. The dilemma for any potential new suitor is a breakup fee Kemper signed with Conseco in June. Kemper agreed to pay Conseco $100 million if it breaks the agreement and sells itself to another company. CHICAGO (AP) Kemper Corp. has apparently attracted at least two new suitors now that Conseco Inc. has proposed a change in the terms of its merger agreement with the mutual fund and life insurance company. Dean Witter, Discover & Co. and SunAmerica Corp. have told Kemper investment banker Goldman, Sachs & Co. they are interested in a deal. General Electric Capital Corp., a unit of General Electric Co. whose $60-a-share offer was spurned by Kemper recently, also expressed an interest, The Wall Street Journal reported. Dean Witter, SunAmerica and GE Capital declined to" comment on the reports Wednesday. In June, Kemper signed a merger agreement that called for Conseco to acquire Kemper for $3.25 billion, or $67 a share. But Conseco, reflecting on rising interest rates that would affect any debt financing, later said it did not believe shareholders would approve the deal.
