Supreme Court Judge Edward J. McGoldrick ordered them to set down "Do-do-de do ho-de-wa-da-de-da." The "Boop-oop-a-doop" trial. In which Helen Kane seeks $250,000 damages from the animated carton creators of "Betty Boop," became thus complicated when Lou Bolton testified for the defense.

Bolton testified that nine years ago in Chicago he taught Baby Esther, a Negro child under his management, to interpolate "Do-do-de-do-ho-de-wa-de-da" between the bars of music in popular songs. "Will you spell that?" asked a court stenographer. "I can't," replied the witness. "Put it down as it sounds," ordered Judge McGoldrick. Bolton said Miss Kane heard Baby Esther's song treatment here in 1928 and shortly afterward began her famous "Booping." Testimony also was heard today from Bonny Poe and Margie Hines, two petite, piping-voiced misses who said they were hired by the Max Fleischer studios as voices for Betty Boop after winning "Helen Kane contests." Miss Hines said she won a preliminary contest before she ever heard Miss Kane.

The action of the House todav virtually completed legislative work on the revenue bill which now calls for $417,000,000 in new taxes for 1934, or $159,000,000 more than provided for in the original bill drawn By the House Ways and Means Committee. Report Near Adoption Senate conferences had become reconciled to the strong opposition of the House to the Couzens amendment and the upper house is expected to adopt the conference report without further debate.

Congressional leaders expect the bill to be sent to the White House late this week. Debate on the motion bv Representative Thomas O'Malley to concur in the Couzens amendment, was desultory. Representative O'Malley argued American citizens who were earninc a good salary during these days of the depression should be willing to pay an extra 10 per cent tax for patriotic purposes. Mindful that they must face their constituents for re-election in November, however, Congressmen showed only a casual interest in this appeal to patriotism and voted down Mr. O'Malley "3 motion 167 to 45.

Carries 283 to 77 Representative Samuel B. Hill a member of the House Ways and Means Committee, then moved that the House insist upon its rejection of the Couzens amendment and the motion carried, 283 to 77. The conference report on the rest of the bill was adopted by 252 to 109 after Republicans had directed a stinuinK attack against it. They alleged the House conferees had surrendered completely to their Senate colleagues. Representative Allen Treadway veteran member of the House Ways and Means Committee and one of the Republican conferees who refused to sign the conference report, predicted taxpayers would revolt against the tax bill and sought to place the blame for the uprising upon the Democratic Party.

FIRE CAPTAIN DIES Veteran Officer Is Victim of Pneumonia Attack Captain Benjamin Lavanthal. 44, of Fire Truck Company No. 46. Sandusky Street. North Side, died in Montefiore Hospital early today from pneumonia.
