1-9440 CHICAGO, Feb. 27 (UPI) -State Representative John W. Lewis Marshall, handed former Republican Gov. William G. Stratton $50 at Stratton's trial for income tax evasion yesterday after he testified that Stratton was a knowledgeable governor.

Lewis appeared for the defense In the eight-week-old trial of Stratton who is charged with evading about $46,000 in income taxes from 1957 through I960, his second term. Lewis said that he had served under four Governors Green, Stevenson, Stratton and Kerner. "They all have been fine men," he said. "But I never met any man who had at his fingertips the knowledge of state government without having to refer to records that Gov. Stratton had.

I'm going to give him $50 and hope he uses it to run for office where I can support him again." Then Lewis left the witness stand, walked to StraWon and handed him the cash. Thanked by Stratton Stratton rose in surprise and Mid to Judge Hubert L. Will: "Your honor, I would like to accept this from John as it is my birthday today." He is 51. "I don't control contributions," Will replied. The jury smiled.

Stratton pocketed the money and shook hands with Lewis. Other witnesses included Waukegan (III.) News Sun publisher Ward Just. He testified that he and a group of Lake county residents contributed more than $19,000 in cash to Stratton funds from 1956 to 1960. Defense attorney George Crowley asked Just whether he placed any restrictions on these gifts. "None whatever," Just said.

Persoanlly, Just said, he gave Stratton $3000. "I was interested in furthering his political career. He was head of the party. He was calling the signals." State Patrolman Testifies State police Sgt. Leonard Wertz, Pontiac, Stratton's driver and supervisor of police at the Governor's mansion in Springfield when Stratton was in office, testified that he got cash to pay some political expenses.

The defense has argued that the government, in its prosecution of the case, failed to credit uch funds as reimbursable, and listed them as personal expenses. Judge Will has ruled that the Jury of six men and six women must decide whether Stratton's campaign contributions could be used without restriction for personal expenses. Earlier, former Cook county Republican chairman Francis X. Connell testified that he had talked politics with Stratton at the latter's houseboat and lodge payment of expenses on these places figured repeatedly in government testimony. Lewis also told of political meetings in the lodge and said that it was an "advantage" to have a hideaway for such conferences.

"When you're governor its necessary to have some privacy," he said. MAN STRUCK WITH HAMMER IN SERIOUS CONDITION Edward A.
