fl i 4B ST. LOUIS POST-DISPATCH FRIDAY, JANUARY 10, 1997 Admitted Killer OK'd To Act As Own Attorney By William C.Lhotka Of the Post-Dispatch Staff A judge is allowing confessed sniper Joseph P. Franklin to represent himself in his mur der trial this month. Franklin is accused of killing one person and wounding another while shooting at people at a synagogue in Richmond Heights nine years ago. St.

Louis County Circuit Judge Robert L. Campbell said Thursday that Franklin had a constitutional right to represent himself. Last month, Franklin, 47, testified that he should die for the murder of Gerald G. Gordon, 42, of Chesterfield, in October 1977. Franklin has said he fired five shots from a grassy knoll into a crowd outside the Brith Sholom Kneseth Israel Congregation.

He said he wished he had killed five people with the five shots. Franklin told the judge Thursday that he considered the case against him overwhelming, and he expects a jury to give him the death penalty. Nonetheless, he wants to represent himself; he wants a triaKby jury; and he does not intend to plead guilty, he said. Campbell ordered public defenders Karen Kraft and Richard Scholz to help Franklin on legal issues at the trial. Kraft and Scholz had tried unsuccessfully to get Campbell to de clare Franklin incompetent.

Campbell let Scholz question Franklin. Scholz asked him what evidence was so overwhelming. "Well, they have a composite sketch of the killer that is a very strong likeness of me," Franklin said. "They have my confession on videotape They also have my verbal confessions." Franklin added that he "knew things about the case that only the killer would know." Such as? Scholz asked. Franklin said he knew the exact make and caliber of the murder weapon, the layout of the synagogue and its parking lot, and the nail the killer had hammered into a post to balance the rifle.

Campbell overruled efforts by Kraft and Scholz to withdraw from the case, saying they were able to assist Franklin on legal matters -even if they thought he was innocent by. reason of insanity. Franklin is a former member of the Ameri- can Nazi Party and the Ku Klux Klan. He is serving six life sentences for racially motivated murders in Utah and Wisconsin.
