Vu OR VS Back A circuit judge in Hillsboro has ordered the prosecuting attorney of Jefferson County to expunge but only partly the arrest record of Patricia Stallings, who was falsely convicted in 1991 of poisoning her infant son. Judge Gary Kramer issued the order last week on a petition Stallings had filed in July. An earlier order for agencies in the justice system to expunge Stallings' records had failed to include notice to the prosecutor's office. Prosecutor George McElroy said that he was happy to purge his files of the Stallings case but that state law required him to keep some information on felony charges indefinitely.

Kramer, McElroy and Stallings' attorney, Marsha Brady, discussed the problem in light of a new law on expunging records of people falsely arrested or charged. Kramer held that certain information on the Stallings case must be kept by the prosecutor. But that information is to remain confidential. McElroy said it will be available to law enforcement agencies "on a need-to-know basis." He said he thinks the law on retention of arrest information should be reviewed with an eye to disposing of old files, especially of persons who have been acquitted or had cases dismissed, like Stallings. Stallings filed the petition after McElroy offered to show his files on her case to Robert Wilkins, his opponent in the Democratic primary for prosecutor.

Wilkins won the race. He got more than $10,000 in campaign donations from Stallings, who had accused McElroy of prosecuting her while knowing her son may have died of a genetic disorder rather than antifreeze poisoning. McElroy denied any wrongdoing in the case. In a newspaper ad shortly before the Aug. 2 election, McElroy used an excerpt of a letter from a doctor at St.

Louis University Medical Center who said he thought McElroy had handled the case properly. PEERLESS PARK Aldermen To Inspect Haunted House Probe Follows Report That A 9-Year-Old Boy Was Injured Slightly BOUND GAGGED By Dona Summers By Barbara Yount Post-Dispatch Special Correspondent The Peerless Park Board of Aldermen plans an inspection of Silo a commercial haunted house, after a report of an injury to a 9-year-old boy last weekend. Alderman Patricia Ward, 2nd Ward, said her son, Stephen, had suffered a scrape across the chest from either a protruding nail or a board when he went through the haunted house Saturday night. "He fell into the wall when a guy on stilts came up behind him and pushed him," she told aldermen on Monday.

Ray Kohout, who owns and operates Silo at 899 Meramec Station Road, said the boy was among a group of four friends who had been through several times. "They're aggressive and hard to control," said Kohout. it's dark and there's fog, they're apt to run into the walls if they go through so fast." But Alderman Greg Lasky, 2nd Ward, asked, "If that's one nail, how many more are sticking out? I think it should be gone through in the daylight and checked out. Besides, they're not supposed to touch any customers." Police Chief Richard Ward confirmed two other accident reports since Silo opened Sept. 9.

He noted reports of a twisted ankle and a couple bumping heads. About 1,500 people go through Silo on weekend nights, the chief said. Overall, he said, "They're doing a good job this year. They're running a good show in an orderly fashion, and the owner is providing good security." Building Commissioner Jim Brig-ham is expected to walk through Silo this week. He inspected the facility this summer prior to the board's issuing a business license.

Silo is open on Thursday and Sunday nights from dusk to 11 p.m. and on Friday and Saturday nights from dusk to 12:30 a.m. Beginning Saturday, and through Oct. 31, it will be open Tuesday through Sunday nights. In other business, the board authorized its consultant attorney, Thomas Wehrle, to proceed with contract negotiations with St.

Louis County Water Co. to complete the last part of the city's $360,000 water project. Aldermen hope to turn the maintenance and operation of the water system over to the county by the first of the year. Resident Gene Perstrope says the project is too big for the area and will ruin the historical sites. "The development will block my view of the river," Perstrope said. "I know I'm only one resident but I've lived here for 30 years. I moved out to get away from all this." Perstrope says the area being considered is in the flood plain. "If more ground is brought in, the floodwaters will be moved onto someone else's property," Perstrope said.

Gaddy Post-Dispatch Special Correspondent The Jefferson County Planning and Zoning Commission has approved the revised preliminary plan for the Lady Luck Entertainment Center in Kimmswick. The Jefferson County Commission approved a preliminary plan April 26 with several stipulations, including a more detailed drawing of the gambling operation. The revised plan shows the precise layout of automobile parking, the amusement center, the hotel and restaurant and open green spaces. Planning Director Don O'Donniley says that approval of the revised plan does not mean the developer can start building.

No building will be started until the final plan is approved. Opposition to the revised plan came from Joseph P. Cunningham III, attorney for the Kimmswick Historical Society. He said the plan should be tabled until the Circuit Court has ruled on Lady Luck's proposal. The Historical Society is appealing the County Commission's decision in court, and the court has ordered the county to halt any further action on the development pending the court's review of the commission's decision.
