1 on the charts for 1954 and No. 8 on the pop charts for the Penguins. The Crew-Cuts, a white band, did a remake that became an even bigger pop hit (as was the case with "Sh-Boom," originally recorded by the Chords). But for Sinclair and his band, the Turks, there was no money and no credit. Sinclair later accepted a $5,000 out-of-court settlement "because I'm a fool." "You got to understand that there were a lot of black boys with talent in Los Angeles in 1954, and not much money," Sinclair says.

"We were young kids and we didn't know what we were doing. Somebody walks up to you and tells you, "Hey, here's $50 for that you think you're into real money." In the 60s, Sinclair progressed rap-, idly in the jazz world. He hung out with Miles Davis and Dexter Gordon, and their sidemen. He landed a recording contract, but at his peak of LA popularity, Sinclair was caught on a drug charge and spent a year in jail, emerging an expert on heroin. "Well, obviously my career just went to pot," he says, grimly punning.

"That took me out of the game for five years." When he came out of the haze and kicked the habit it was 1971, arid rte' was playing in Chicago a good-time, he says, when Sonny Stitt and Dexter Gordon would join him on stage. But by 1977, the good times hatl faded. That's when John Dahlstedt of the University of Illinois music department struck up a friendship with the saxophone man at the Quasar Lounge and talked him into coming to Champaign. Charlie Mingus was playing in those days at the Ruby Gulch, a small bar on Green Street, and Chicago musicians would make the trip down to jam with Uncle Guido and other South Side veterans. "I said I was going to stay a couple weeks," Sinclair says, "and somehow it's been eight or nine years." Besides playing at Nature's Table, Sinclair this winter is recording his own compositions something he said he should have been doing all along.

"Everybody on the record is from my school of music," he says. "And my school of music is just hanging out." (AP) If you really like jazz and Guido Sinclair seems to you don't keep music to a 9-to-5 schedule. Sinclair has shared the stage with jazz greats, had a hand in a few minor hits himself with rhythm-and-blues bands 30-odd years ago, and is reworking his compositions to record them this winter. When he wants to play his saxophone, it doesn't do much good to remind him of the late hour or the neighbors or work the next morning. "Uncle Guido blows in at 3 o'clock in the morning, and if he wants to jam BLAM! you jam," says fellow musician Vicki Alexander, who isn't complaining. More than once, Alexander says, she has sat in her night robe blearily watching jazz musicians file into her home in Champaign, then picked up her own sax and joined in.

"No, I don't get bored, ever," says Sinclair, 54. "The cats I play with keep it interesting." The musicians who play with Uncle Guido at Nature's Table, a health food restaurant, are an irregular group, but their strong point is improvisation. "We live together and we play together, and we're comfortable with each other," says drummer Danny Deckard. "Guido's been on the street so long he can hear just a little bit of something and take off with it." Sinclair's 40-year career has careened near success, but a prison sentence took him off track, and heroin addiction robbed him of good work and a personal life. "I'm a living example of how terrible heroin is," he likes to say.

Old friends say the hard years turned him from a man glib and easy with the saxophone into a teacher and composer whose work is deepened by pain. "Now, mainly he's a survivor, that's why he's so good," says Jon Regulus, a Chicago musician who has known Sinclair for 30 years. Sinclair grew up in a musical family shuttling from Los Angeles to Fort Worth to Chicago. He dropped out of high school to play rhythm and blues on the LA club circuit, and had a hand in Chuck Higgins' early 50s hit "Pachuco Hop." He composed "Earth Angel," Cahokia Dolores Trepka, 60, died Friday, funeral today, Braun. Collinsville Peggv L.
