3 MAY 19 1988 4B ST.LQUIS POST-DISPATCH THURSDAY, MAY 19, 1988 Environmental Claims Made Part Of MX Suit Celebrity 'Felons9 Are Jailed Although "Go to jail" is the unlucky card to draw in the game of Monopoly, the American Cancer Society is having good luck play- "ing it to bring celebrities and oth-" "ers to the bars of justice as a way of raising money for cancer research. Makeshift hoosegows have been erected in St. Louis Centre and five suburban shopping malls to- hold the "jolly good felons." For a $25 donation from fellow workers, friends or spouses, the "felons" are served with official- looking warrants by 22 participating police departments and hauled to the jails until the "felons" make bail. The third annual Jail-A-Thon got under way Tuesday and runs through today. The Jail-A-Thon concludes today at West Port Plaza, South County Shopping Center, Chesterfield Mall and Jamestown Mall as well as St.

Louis Centre and Plaza Frontenac. Hours are 10 a.m. to 3 p.m. Requests for "arrest" may be made by calling 567-9730. curred in the majority opinion.

Three judges Richard S. Arnold, Myron H. Bright and Theodore McMillian agreed-with most of the majority's opinion but said the alternatives to the silos, should be a part of the environmental study. The minority said Congress did not decide in 1984 that.aJJ future missiles be placed in silos, as the majority held. It cited reports that Congress was considering placing some missiles on railroad cars.

"A comparison of the environmental impacts of the two basing modes, and perhaps of others as well, is crucial to this debate," Arnold wrote. the MX missiles authorized for deployment. But it said federal courts lacked the power to consider demands by the environmental groups that the study include a discussion of alternative weapons systems, bases, or their wartime use. "Congress did not want its basing mode choice impeded by time-consuming litigation or second-guessed by intermeddling courts," Heaney wrote. Chief Judge Donald P.

Lay and Circuit Judges John R. Gibson, George G. Fagg, Pasco M. Bowman, Roger L. Wollman and Frank J.

Magill con the 8th Circuit court overturned that ruling, but the full court then agreed to take up the case. In its decision Wednesday, the court said the plaintiffs' claims that the environmental study was inadequate must be heard in court. The court rejected the contention of the Air Force that the environmental questions surrounding the missile project involved political and national-security issues that were within the sole domain of the president. The court noted that in legislation authorizing the MX missiles in 1984, Congress required environmental review. "Obviously, Congress was concerned about the potentially dangerous effects of a nuclear missile project on the civilian population during peacetime," wrote Circuit Judge Gerald W.

Heaney. "We simply do not accept the contention that such an explicit statutory command on an issue this vital to the health and well-being of citizens (is) unreviewable." The court said the need for an environmental study applied to all of By Tim Poor Of the Post-Dispatch Staff A federal appeals court here ruled Wednesday that a judge must consider the environmental claims made in a suit that seeks to block the deployment of MX missiles in the Midwest. But the 8th U.S. Circuit Court of Appeals said the courts could not take up the question of whether, the missiles should be put in silos or elsewhere. Plaintiffs in the case include several environmental and anti-nuclear groups, as well as Richard D.

Lamm, the former governor of Colorado, and Roy R. Romer, now Colorado's governor. The plaintiffs oppose the deployment of the missiles and want a more detailed environmental impact statement before the missiles are deployed. In February 1986, U.S. District Judge Warren K.

Urbom of Nebraska ruled in favor of the federal government and denied a request by the plaintiffs for a court-ordered environmental study.
