She said that she had asked Whitworth to explain and that he had said, "Me I did it" and further, "The man already identified him, and they can't do anything to me now." Ruemmler then notified Cossey's attorney of the conversation and told her own office that she had become a defense witness and could have nothing more to do with the case. The charge against Cossey was dropped, and the prosecuting attorney's office filed the same charge June 16, 1983, against Whitworth. His attorney objected, but Ruemmler was allowed to appear as a witness in his trial. The majority of the appeals court here ruled that Ruemmler's status as an assistant prosecutor did not disqualify her as a witness. The fact that her office tried the case did not affect her credibility, the majority said.

The judges pointed out that even if a special prosecutor had been appointed, Ruemmler's position as assistant prosecutor would have been brought out. The majority opinion was written by Judge Carl R. Gaertner. Concurring were Judges James R. Reinhard, Robert G.

Dowd, Albert J. Stephan Robert E. Crist and Paul J. Simon. Judge Kent E.

Karohl, in writing the dissent, called the prosecution "fundamentally unfair." He pointed out that in closing arguments, the prosecutor had "compared the credibility of the assistant prosecuting attorney as a witness with the testimony of the defendant rather than emphasizing the direct evidence of guilt." By Thorn Gross Of the Post-Dispatch Staff The Missouri Court of Appeals at St. Louis has ruled that an assistant prosecuting attorney may appear as a witness in a trial being prosecuted by her office without prejudicing the case. The court said Tuesday in a 6-3 ruling that John Keith Whitworth had got a fair trial in Jefferson County Circuit Court in which the assistant prosecutor testified. But the dissenting judges sent the case to the Missouri Supreme Court because in a recent case in western Missouri an appeals court ruled the opposite way. In that case, the appeals court said the Jackson County prosecuting attorney should have been disqualified because an assistant prosecuting attorney had witnessed statements of the defendant.

The Jefferson County case involved a charge of carrying a concealed weapon. On Dec. 7, 1981, a bearded man entered a liquor store-owned by Marian Thompson, a former police officer. Thompson saw that the man was carrying a gun and appeared to be reaching for it. Thompson pulled a gun of his own and disarmed the man.

The man then was joined by a second bearded man, and they left together. Thompson took their license number and reported the incident to police. Thompson later twice identified Larry Cossey as the armed man. After a preliminary hearing for Cossey on June 11, 1982, assistant prosecuting attorney Marilyn Ruemmler was approached by Whitworth, who she said had complained about prosecution of Larry WilliamsPost-Dispatch knight in armor to publicize an exhibit of arms and armor in Gallery 120 on the lower level of the Art Museum. A judge ordered Tuesday that proceeds from the sale of any car by the Charles Schmitt Co. dealership be placed in an account at Boatmen's Bank of Concord Village. 22 on suit seeking to take over Schmitt's inventory of exotic and classic luxury cars. The dealership is at 3500 South Kingshighway. Meanwhile, Schmitt attacked the bank's action as a personal vendetta against him by the bank's president. Schmitt said he had embarrassed Boatmen's president, David V. McKay, twice recently in financial dealings.

The bank's suit alleges that Schmitt is in default on two demand notes of $1.2 million and $800,000. A demand note is a loan that allows the lender to demand immediate repayment at any time. The cars are collateral on the notes. St. Louis Circuit Judge George A.

Adolf scheduled the hearing for Aug. 22 after meeting with both sides Tuesday morning. Attorneys for Boatmen's are seeking an order of contempt of court against Schmitt because he refused to turn over the cars' titles to a sheriff's deputy Monday afternoon. The deputy was acting on an. order Adolf issued Monday morning.

Attorneys for Schmitt argued for a motion to stay the order to seize the titles. In an interview Tuesday, Schmitt said Boatmen's action had been motivated by McKay's personal grievance against him. Schmitt also said he believed that the bank was "in cahoots" with Rolls-Royce Motors to try to run him out of business. He said the automaker was out to get him "because I'm the best they've got." He said the 69 other Rolls dealers in the United States had resented him for a long time because he discounts the cars. Schmitt said the bank's suit already had hurt him.

"Today, we're on a C.O.D.," cash on delivery, "basis all over town. McKay's made it impossible for me to get a loan in this town I have to go outside. But that's OK with me." Schmitt built the world's largest Rolls-Royce dealership from a $65 investment in a car wash. McKay was quoted in 1983 in an article in the Wall Street Journal as saying about Schmitt, "Charles owns his house, an entire city block for his business, and he doesn't owe a penny on his inventory." Agent On Trial Was Soviet's 2nd Target Deaths Compiled From News Services LOS ANGELES A Soviet spy accused of using sex and gold to lure an FBI agent into selling secrets had tried two years earlier to seduce another agent, the second man testified Tuesday. In the trial of his former colleague, Richard W.

Miller, retired agent John Hunt detailed a period in 1982 when he was evaluating Svetlana Ogorodni-kova as a potential informer. He said she had provided him with some information about Soviet consular officials in San Francisco, but eventually had proved too unreliable. The flirtatious and irrational behavior he described are part of what the government claims ensnared Miller in a sexual liaison with the woman and got him to agree to give her documents for $65,000 in cash and gold. The woman and her husband, Nikolai, pleaded guilty in June of conspiracy and are serving prison terms. Attorneys for Miller, 48, contend that he gave Ogorodnikova no documents and that he was using her to penetrate the KGB in an effort to pump up his poor reputation at the FBI.

They say the only difference between Miller's and Hunt's dealings with Ogorodnikova was that Hunt's method failed and Miller's although unorthodox succeeded in the first phases. Ad Messages To Spy The FBI sent coded messages last summer in classified ads in the Los Angeles Times in an effort to arrange meetings with a man suspected of being part of a Navy spy ring, according to a published report. The ads were addressed to "RUS" a code name the. Federal Bureau of Investigation says was used by Jerry A. Whitworth, a retired Navy radioman, The New York Times reported Tuesday.

U.S. Panel Studying Crash Of Homemade Plane Nelson B. Tinnin; Former State Senator The National Transportation and Safety Board is investigating the crash of a homemade aircraft that crashed Monday night in north St. Charles County. The crash killed the pilot, Ronald D.

Houk, 27, of the 1300 block of Jackson Lane in Florissant. The accident occurred about 8 p.m. Monday in a cornfield about 1 '2 miles north of the St. Charles County Airport in the Orchard Farm area. Houk had apparently just taken off from the county airport, also known as Smartt Field, said a spokesman for the St.

Charles County Sheriffs Department. He described Houk's aircraft as having helicopter blades that were free-wheeling for lift purposes. The craft is similar to the Ultralight or motorized gliders. Houk's plane was moved forward by a pusher propeller mounted directly behind the pilot. A witesss, Floyd Brown of Portage des Sioux, says the plane was about 100 feet high when he heard the engine stop, start again and then stop.

Brown called the airport and also the Sheriff's Department. The airport alerted a private pilot in the area; that pilot was circling the wreckage when the sheriff's deputies arrived. 1 A funeral service for Nelson B. Tinnin, who served as a member of the Missouri Senate for 24 years, will be Friday at 10:30 a.m. at the Poplar Bluff Methodist Church.

Burial will be in the PoDlar Bluff elected to the Senate in 1960 and retired in 1984 without seeking re-election. He was the senior member of the Senate at the time of his retirement. For many years, Mr. Tinnin held the rare position of being chairman of two major committees of the Senate agriculture and education. As head of these two committees, he sponsored many farm and education bills.

Although Mr. Tinnin's subdued speaking style made it difficult to hear him in the Senate chamber, he was known for his tenacity in bringing back legislation year after year until he succeeded in passing it. Surviving are his wife, Lora, who often assisted Mr. Tinnin in his Senate office; two sisters, Ruby Wiser of Jefferson City, and Opal Snyder of Ken-nett; and a granddaughter, Tracy Tinnin of Sikeston. FABIAN, ROBERT, 47, formerly of St.

Louis, fatally injured on Auo. 6 in an auto cemetery. Tinnin Mr. Tinnin, 79, died Tuesday in Methodist Central Hospital in Memphis, where he had been under treatment for about three weeks for a respiratory illness. He was a cotton ginner and planter from Hornersville.
