Mrs. Ladwig said she discovered about 4:30 p.m. Friday that treasurer's office records were still in the auditor's office. The two offices are across the hall from each other in the County Administration Building, 118 North Second Street, St. Charles.

County Treasurer Theodore M. Peterson a Republican who took office Jan. 1, and Nichols, a Democrat who has held office for two years, have been involved in a disagreement over the adequacy of the records Peterson inherited. Peterson had left early Friday. When Mrs.

Ladwig went to retrieve records from Nichols about 4:30 p.m. Friday, she said, auditor's office personnel warned her that an audit was in progress, and the records should not be removed from Nichols' possession. Mrs. Ladwig said she saw a box of records, picked them up and returned them to the treasurer's office vault for safekeeping over the weekend. She Scholars From page one Westminster Drive, St.

Nichols said that state law gives him unlimited access to such records during an audit. "I've warned that office about four times about my access to records," he said Monday.

Mrs. Ladwig said that she tried to block him from going into the vault, and got pushed hard into shelving at the rear of the vault. Nichols' version is more or less the same up to his attempted entry into the vault. "I walked over to the vault to get the records," he said. Recent attempts have been made in the state Legislature to thwart this sort of book thief. The Missouri Library Association is behind a bill that is still in the local government committee of the Missouri House of Representatives.

Marilyn McCIoud, executive coordinator of the association, said the bill deals with the theft of books as well as all the materials that are available at films, records and microfilm, to name a few. The intent of the proposed legislation is not to "willy-nilly prosecute people," said Ms. McCIoud. "It is not Intended to intimidate the average library user with overdue books." In Kansas City, 27,000 books are lost each year, and in St. Charles County, 13,000, according to the association's figures. "If you figure each book is worth a minimum of $10 that includes the value of a hard-back book plus staff time for processing that's quite a bit of money lost. The bill would right that," said Ms. McCIoud.

She said that representatives of the St. Louis Public Library system have reported that many lost and overdue books have already been returned, as patrons learned of the proposed legislation. Under the provisions of the bill, the library would first exhaust its normal avenues in notifying patrons that their books were overdue. "There are safeguards all along the way. We don't want to prosecute, we just want our material back," said Ms. McCIoud. St. Charles will not be alone with its new security system.
