Alexander said in his opinion, was that the case was void since it was an attempt by the city commissioners to encumber the city's electric power system without a vote of the people. GBRA contented that San Antonio had previously agreed to the lease contract as a condition to its right to acquire the property and that it acquired the property burdened with the lease. The GBRA assigned the lease on the power plant on to the Lower Colorado River Authority. Under terms of the lease contract, the GBRA would pay the city of San Antonio $250,000 annually for the plant.

The contract carried the stipulation that San Antonio would purchase sufficient current to pay the lease, and San Antonio had the right to contract current necessary for the full operation of its electric system.
