Oct. 20 (AP) The Nationl Labor Relations Board ruled 3 to 1 yesterday that employers must bargain with unions on plans to give workers part of their pay in company stock. Employers have sometimes bargalned.voluntarily with unions on workers' stock purchase plans, under which companies contribute part of the cost. But It was the first NRLB edict that such bargaining is compulsory under the Taft-Hartley law.

The decision appeared to add workers' stock acquisitions to pensions, insurance, profit-sharing and other matters besides waees which the NLRB and courts have held are within the cope of collective bargaining. The case involved a demand by the CIO Oil Workers international for improvement; in the employe stock purchase plan inaugurated by the Richfield Oil Los Angeles. Both company and workers contribute to buy stock for the employes. The firm refused to bargain on the issue, contending it would amount to being compelled to deal with the union on company ownership and control, and eventually on dividend, debt and financial policies. Under the law, employers are compelled to bargain on "wages and other conditions of employment." The majority held that employer contributions toward stock purchases in the Richfield plant amount to "wages" since they "represent a part of the compensation or remuneration received by the employes for their labor." The majority was composed of Chairman Guy Farmer and Members Ivar Peterson and Philip Ray Rodgers.

Member Ade Murdock did not participate in the ruling. In a vigorous dissent, Member Albert Beeson said he considered the ruling contrary to both the wording of the law and the intent of Congress, and added: "It is difficult to conceive of any more flagrant invasion of what was heretofore considered the legitimate right of employers, designed to be protected by the act." Richfield officials In Los Angeles said that "the principles involved are so Important that we will appeal the decision to the Federal courts."
