The 250 tenants of the middle tower of the Mansion House Center remained out of their apartments Tuesday while electricians worked to restore power to the building. The tenants were evacuated Monday afternoon after an electrical fire in a sub-basement sent smoke through the building and knocked out all power. "We don't know when full power will be restored so the tenants can move back in," said Gerald A. Rimmel, a lawyer. He was appointed by the federal court to be the receiver in charge of the Mansion House Center.

"Until all power is restored, we've got contingency plans that call for the tenants continuing to stay at the Holiday Inn next door," Rimmel said Tuesday. The hotel is the south tower of the Mansion House Center. Some trustees of the police retirement system recently asked the city counselor's office for a review after learning that Donald Brocksmith had got a finder's fee when the pension fund's trustees considered investing as much as $55 million with the bank. Brocksmith, the bank's operations officer, is married to the daughter of Manuel Delgado, a police lieutenant and pension fund trustee.

Brocksmith has said he told the bank about the opportunity after discussing it with Delgado. The board has yet to select a bank. In a letter made public Tuesday, City Counselor James J. Wilson stated the following findings: Delgado made no effort to influence the selection of Commerce Bank. Brocksmith's employment had no effect on the pension board's tentative selection of Commerce Bank.

The payment of the finder's fee was in accord with the bank's existing program. There is no evidence that Brocksmith implied in any manner that he had the ability to obtain the pension fund's business through his father-in-law's position. There is no evidence that either Delgado or Brocksmith knew of the bank's finder's fee program when they discussed the pension system's search for financial advisers. In the various discussions by the pension board trustees, there was no evidence that indicated the withholding of information from either any trustee or the public. Wilson said he saw nothing that would create a legal impediment to the pension trustees' executing a contract with Commerce Bank.
