Federal retirees are receiving refunds because a court ruled that their pensions had been taxed illegally. The state had exempted state and local pensions while taxing federal and private pensions. The Legislature approved the increase in the state sales tax in July. The increase will raise $60 million; it will expire after nine months. The money will help pay for tax refunds owed to federal retirees.

The increase brings the state sales tax to 4.425 percent. Including local sales taxes, the rate in the city of St. Louis will be 6.3 percent. In St. Louis County, the new rate is 5.925 percent.

Merchants should be ready for the change, said Deborah Ausmus of the Missouri Department of Revenue. State's Attorney Richard J. Ringh-ausen of Jersey County got the order Thursday after he filed a motion seeking an examination by at least one psychiatrist or psychologist of his choice. Eveans' attorney, Arthur S. Margu-lis of St. Louis, did not oppose the motion.

"We thought that was a logical course to pursue," Margulis said Friday. The order was issued Thursday by Circuit Judge Claude L. Davis of Jersey County. It also allows Eveans to get an evaluation by a psychiatrist of her choice. Ringhausen said Friday that he had yet to decide who would conduct the evaluation or when it would be done.

Davis also set a tentative trial date of Jan. 16. Eveans, 23, is charged with murder in the smothering of Richard W. Eveans Jr. on July 19 his third birthday.

The Illinois State Police said an autopsy showed that the boy died after someone held a hand over his mouth. Eveans also is under investigation in the deaths of her two other children in 1987 and last year. That investigation is being handled by authorities in Macoupin County, where Eveans lived when those children died. Assistant State's Attorney Brent Cain of Macoupin County had no comment Friday on the investigation. Robert Wayne Eveans was 7 weeks old when he died on Sept.

25, 1987. His death was attributed to meningitis caused by an accidental skull fracture. Police said Tammy Eveans reported that Richard Eveans Jr. had pulled Robert Eveans off the kitchen table, causing the head injury. But Dr.

Mary Case, the St. Louis County medical examiner, said in August that the kind of skull fracture the infant suffered could not be inflicted by that kind of accident. Case has been called in as a consultant in the investigation into the other deaths. Tammy Eveans' third child, Amy Cecille Eveans, was 16 days old when she died on Sept. 1 of last year.
