District Judge Davis. Abraham Tober, president of the Tober-Salfer Shoe and holder of 600 shares of stock in the Missouri State Life Insurance for which he paid $62,000 in 1930, today obtained leave to intervene as plaintiff in a suit now pending in Federal Court here, attacking the action of Supt. K. Emmet O'Malley in turning over the Missouri State Life assets to the General American. The suit, pending before Judge Charles B.

Davis, was filed by George H. Holley. Holley's petition asks that the Court appoint re ceivers to administer the funds turned over by Supt. O'Malley to the General American Co. "without authority," as the petition charges.

It Is asked that the receivers administer the funds "for the benefit of all creditors." Holley's suit is based on the con tention that O'Malley had no authority to transfer the insurance company's assets, though he may have had power to sell or reinsure the company. Tober's lawyers, in asking leave to intervene, said their action had been brought about by the revelations in the Sabath committee's inquiry at Chicago. The lawyers are William H. Woodward, Louis Mayer and Irl Rosenbloom. Royal Bond Employes Get Bonus.
