VS. CHOUTEAU. A Special Jury Try the Famous Malicious l'i'Otteeution Case. A special jury was impaneled in court room No. 4 this morning to try the damage case of Charles h.

t'eck vs. Charles P. Cliouteau, Joseph H. Livingston and John M. Glover.

The suit is for damages for malicious prosecution, and grows out of the old Windsor Hotel litigation. The plaintiff claims that on July 1. 1S82, the defendants, bv false statements lepieseutations made by the defendant Joseph H. Livingston, at the instance and request of the other two defendants, rvrocurert his indictment upon a charge of fraudulent conspiracy with Bernard H. En-gHke, and Edward P.

Barrett to defraud Mrs. Alice Livinnston aud others interested the Windsor Hotel Company. The petition further states that the defendant, Charles 1'. Chouteau, was a member of the Grand Jury which returned the indictment. On December 21, lss2, the plaintiff was acquitted.

For a second cause of action tho plaintiff states that oil December -i. 1S2. after the proceedings in the Criminal Court had fallen through, the defendant, John M. Glover, at the instance of Mr. Chouteau, made au affidavit, ciiirsmg him with conspiracy to defend Mr.

Livingston, and compelled the plaintiff to appear before the Court of Criminal Correction for three days, and he values tne time which lie thus lost from his regular business at the su in-of S25 per day. Afterwards, ou January 15, 1SS3, the defendants are alleged to have procured the plaintiff's arrest aud compelled his attendance at the three tor nine days; his time he estimates to be worth 25 per day. All of the proceedings fell ihruugh. In the present suit Mr. Peck is represented by Judge J.

He has just returned from the prosecution of some car thieves at Cassville, Berry County. For some weeks the company had suffered from tneits along that part of the road. Recently a lot of velvet goods were taken from a case in one of the box cars. Detective Erskine went to Cassville and arrested John and Win. Wilson, and had them locked up at Cassville while he searched their house.

He found some velvet there and returned at once to search the men. He found a pocket Knife with a broken blade withone of the men and turned it oerto the sheriff. The sheriff locked one of the men upiu the Cassville Jail, and he attempted au escape by setting fire to the place. Wm. Wilson was taken home by the sheriff for safe keepiuir.

and while there stole the knife back from the odcer. Erskine interceptea the car. and after a close search fouud tne broken blade in tne car. He at once telegraphed back to recover the knife, which, 011 a second search, was found with John Wilson. Ou the preliminary examination the blade was fitted to the knife and tallied exactly.
