N.Y. schools chief sworn in METRO BRIEFING Rochester man arrested in check-cashing scheme A Rochester man is being held at the Monroe County Jail on charges that he stole checks from his mother and brother, cashing one for more than $112,000. This week's arrest marks the second time gambling appears to have drawn the attention of law enforcement to Joseph Mack Thomas, 37. In 1989, a federal judge sentenced him to 3 Vt years in prison for bilking a New Jersey casino of $500,000.

This time, Thomas faces federal charges of scheming to defraud a financial institution Chase Manhattan Bank. If convicted, he faces up to 30 years in prison, said Assistant U.S. Attorney Christopher Taffe. According to court documents filed by the Secret Service, Thomas was confronted by Atlantic City gambling officials when he tried to cash a check for $112,000 at a casino there. Later, according to documents, Thomas tried to cash the check at the Penfield branch of the bank in the name of John Sebastian on Friday.

Love triangle at bottom of sniping spree THF ASSOCIATED PRESS RIVERHEAD A love triangle involving rival topless dancers emerged yesterday as a man pleaded guilty to murder and other charges in a sniper spree that terrorized Suffolk County last summer.

Peter Sylvester, 25, confirmed in court that he was the rifleman who targeted innocent victims with a rifle over 13 days. One man was killed, a woman was seriously wounded and another man was terrorized before the sniping was over. Paul Gianelli, Sylvester's' attorney, said his client planned the shootings to distract attention from his real target: A topless dancer who had stolen the boyfriend of a rival dancer. Sylvester conducted the shooting spree in order to create a smoke screen for his real victim, the lawyer said. The dancer who was Sylvester's real target was never shot at.

The shooting set off the largest manhunt in Suffolk County history, with more than 200 police officers involved. The defense said the spurned dancer wanted Sylvester to murder her ex-boyfriend's new love. But the prosecution insisted the spurned dancer knew nothing of the shootings until after they occurred. Suffolk County District Attorney James Catterson agreed that Sylvester's shootings were planned as a distraction, and that the new girlfriend was the apparent target. Gianelli said there was "no romantic relationship" between Sylvester and the spurned dancer.

Gianelli said Sylvester might have been trying to impress her. Sylvester pleaded guilty to murder, assault, reckless endangerment and burglary. He faces a minimum of 35 years to life at his Sept. 27 sentencing under terms of the plea bargain to a 24-count indictment. Catterson said the unidentified dancer had waived immunity to testify before the grand jury.

But not all judges who weren't chosen are unhappy. "It doesn't make much difference to me who handles the death penalty cases," Maloy said. "They're going to be lengthy and they're going to interrupt the system." The death penalty returned to New York Sept 1. Death by lethal injection is allowed in some intentional murders, Including the killing of a police officer, contract and terrorist killings, slayings committed during another felony, serial killings, and slayings involving torture.

But so far, prosecutors haven't identified a single case in the state where they would seek the death penalty. Mills had been education commissioner in Vermont since 1988. Mills chose the Bronx school because of its high performance on city and state reading tests. He spent the morning reading to kin-dergartners, sitting in on a meteorology lesson, watching a chess match and taking a turn at Macbeth with a class of sixth-graders. FAA awards $3 million to airport for rescue facility The Federal Aviation Administration has awarded Greater Rochester International Airport a second $3 million grant for a new rescue and firefighting training facility. Rochester was selected as the site for the training facility last year in a competition with several other airports. The award was announced yesterday.

The project is a cooperative effort between Monroe County and Rochester. The FAA awarded the airport $400,000 last year for design work. The initial $3 million grant was announced in April. Construction of the facility is set for 1996. It will include a burn area, fire vehicle maneuvering area and fuel and water storage tanks.
