Jurors determined Prindle was the driver and committed acts so devoid of concern for others that they rose to the level of reckless murder. In his summation to jurors, defense lawyer Thomas J. Cocuzzi cast doubt on who was driving and attempted to discredit testimony from witnesses who put Prindle behind the wheel. The prosecution contends that Prindle and Jeffrey A.

Kells, 32, were trying to elude police after stealing a snowplow from a business on Monroe Avenue in Brighton when Prindle's van collided with a car that was exiting Interstate 490 at South Goodman Street in Rochester. The police had called off the chase in Brighton prior to the crash. Kuligowski, who was returning with friends from a baby shower in Buffalo, died a week later of severe head injuries. Kells, who was arrested immediately after the crash, initially told police that a friend named "Santos" was driving. When Prindle was arrested with his girlfriend a week later, she gave a similar name to police.

Cocuzzi said Kells, who testified that he made up the name of Santos to throw police off Prindle's trail, was not credible because of a deal with prosecutors that allowed him to plead guilty to attempted assault and receive a prison sentence of no more than 10 years. "Mr. Kells is proven to be deceitful," Cocuzzi said. "It is his lifestyle. Lee C. Petty, 46, of White Swan Drive was arrested around 6 p.m. at the Chili Avenue WalMart and accused of stealing a potted plant, a Buffalo Bills cap and a pair of shorts, said Gates Police Chief Thomas Roche. Roche said officers gave Petty an appearance ticket charging him with petit larceny, ordering him to answer the charge in court on Dec. 1.

"But he ended up back in Gates court a little later that day," said Roche. Police say a 48-year-old Chili woman identified Petty that night as the man who stole her purse around 9:30 p.m. in the parking lot of the Diplomat Party House, 1956 Lyell Ave. Roche said the victim was leaving the party house when she was attacked and gave police a good description of both her attacker and his car. Police charged Petty with one count each of third-degree robbery and fourth-degree grand larceny, said Roche.

Berkemeier, Dorothy H. In recognition and celebration of the life of Dorothy (Dot) H. Berkemeier, a memorial service will be held at Wayside Presbyterian Church, 5017 Lakeshore Road, Hamburg, NY on Saturday, November 19th at 10:00 AM. Dorothy passed away at the age of 85 on Friday, November 11 after a lengthy illness in Dallas, TX. She is survived by her husband of 62 years, Robert; her son, Kevin (Gail) of Dallas, TX; a brother, Robert (Sherrell) Bonner of Spokane, Washington; two grandchildren, Kelly and Kyle; and several nieces and nephews.

Her sister, Audrey Hixon preceded her into heaven. Dot was a schoolteacher for just under 40 years in several Western New York school systems and was a very active church and community leader before retiring. She was a member of The Order of the Eastern Star and achieved the Girl Scouts Gold Award. In lieu of flowers, memorials may be made to the charity of your choice in Dorothy's name. Dintruff, Richard Philip Of Bluff Point, NY, died November 10, 2005, surrounded by family, at age 75.

He is (E.J.) Lundy, Burdette "Bud" PhD CANANDAIGUA: Age 82 of Deerfield Dr. Unexpectedly on November 16, 2005 at Strong Memorial Hospital. Native of Jamestown, NY. Dr. Lundy received his masters and PhD from the University of Chicago.

He worked as a Clinical Psychologist for the VA Hospital from 1955. The last 22 years with the Canandaigua VA retiring in 1988. Dr. Lundy served in the South Pacific with the U.S. Army during WWII.

He was a member of the United Church, the Scientific Association, Wood Library, a former Rotarian and an avid sportsman. He is survived by his wife, Lorraine; 3 children, Mark (Aimee) Lundy of Cincinnati, OH, Ruth Lundy of Madison, WI and Craig (Karen) Lundy of Columbia, IL; 5 grandchildren, Michaela, Meghan, Ryan, Hannah, Jacob; several nieces and nephews. Predeceased by sister, LeSuer of Cambridge, MA; brother, Ronald Lundy of Lodi, CA. A Memorial Service will be held Saturday at 1:00 P.M. from the United Church, 11 Gibson Canandaigua.
