FRIDAY, DECEMBER 8, 2006 DemocratandChronicle.com DEMOCRAT AND CHRONICLE Pataki nixes partial ban of wood preservative GANNETT NEWS SERVICE ALBANY For the third year in a row, Gov. George Pataki has vetoed a bill that would partially ban a wood preservative that activists say is linked to health and environmental problems. The legislation, sponsored by Sen. Nicholas Spano, R-Yonkers, would have phased out the use of creosote, a preservative, by New Year's Day while granting an exemption to railroad and utility companies, which account for 90 percent of creosote use. The measure, carried in the other house by Assemblyman Richard Brodsky, D-Greenburgh, Westchester County, would have prohibited creosote use at marinas that service boats, starting Jan.

1, 2009. The bill would have outlawed the burning of creosote-treated products and required they be disposed of in lined landfills to protect groundwater. Pataki said in his veto message that he is against the measure because there was no exemption for facilities operated by the Port Authority of New York and New Jersey and the restrictions on the burning and disposal of creosote-treated wood were "inappropriate." "Further, I am advised that the federal government continues to review this issue and intends to issue a determination in the upcoming year as to whether to reregister creosote as a restricteduse pesticide and what, if any, mitigation measures must be instituted to protect workplace and environmental safety," Pataki said. The federal Environmental Protection Agency is reassessing creosote as part of its program to determine whether older pesticides meet current safety standards. The chemical was first registered in the United States in 1948.

According to the EPA, about 70 percent of all creosote use is for railroad ties and crossties, and between 15 percent and 20 percent is for utility poles and cross-arms. 624-1120 Collins, Frederick H. 72, of Bear Creek Township, died Tuesday morning, Nov. 28, 2006, at Geisinger South Wilkes-Barre. He was born in Massena, N.Y., a son of the late Frederick and Hazel Collins. He was a graduate of Fairport High School, New York, and Rochester Institute of Technology, where he received a Bachelor of Science degree in business.

He was a veteran of the Naval Reserve during the Korean Conflict, a former Scoutmaster and an avid outdoorsman. He resided in Bradenton, from 1975 until his retirement in 2001. Surviving are sons Daniel Collins, Sterling, David Collins, Syracuse, N.Y.: Douglas Collins, Bear Creek Township; Donald Collins, Bradenton, daughter Diane Benke, Syracuse, N.Y.; 16 grandchildren; four great-grandchildren; brother Charles Collins, Parrish, nieces and nephews. Beloved widow of Irving Morris Marcus who died on November 19, 1997. Born in Rochester, NY on October 24, 1927, she was a daughter of the late George and Elizabeth (McLaughlin) Elkins. She was a graduate of East High School in Rochester and the Rochester Business Institute. Until her retirement in 1989 she had been the Assistant to the Director in the Education Department at the University of Rochester Memorial Art Gallery. Formerly a longtime Rochester resident, she had made her home in Wrentham for the past sixteen years.

She had made to move to Wrentham to be near to her daughters and her grandchildren, whom she adored. Family travels and times spent with family were always enjoyed, and she loved her wonderful days near the ocean with them. She is survived by two loving daughters, Leslie and her husband Gerard Lorusso, and Lynn Marcus, all of Wrentham, dear twin brother Glenn and his wife Kaye Elkins, and sisters Geraldine "Jerrie" Elkins, and June Hanlon, all of Rochester, and cherished grandchildren, Allie, Casey, Marissa, Juliana, and Jarred Lorusso, all of Wrentham. She moved to Rochester, New York in 1949 when she began working at Taylor Instrument.

Jane then worked in the Gates Chili School System from 1970 to 1982 when she retired. She and her husband Ken enjoyed traveling with friends during their retirement. Jane then began a successful career in real estate sales at Nothnagle Realtors until 1992. She was a member of St. Pius Tenth Church and member of the Catholic Women's Society.

Harry served in the Air Force during WWII, retired from Eastman Kodak Company after many years, was a member of Pittsford Rotary Club where he was a Past President and a Paul Harris Fellow, was an Elder in the Presbyterian Church and a member of First Presbyterian Church of Pittsford.
