With the precision of a military operation, car-pooling mothers made repeated trips to Scarsdale Middle School in Westchester County to take students out of class for the test, then back for their regular classes, as the exam was administered at different times for three different groups of students. In a case that could significantly affect the state budget this year and in the future, the Court of Appeals heard arguments on whether a governor can kill items in the budget he doesn't like. The legal nitty-gritty centered on whether Assembly Speaker Sheldon Silver, D-Manhattan, has the legal capacity to sue Gov. George Pataki, a Republican, for vetoing $1.6 billion worth of projects in the 1998-99 state budget.

But the underlying bigger issue focused on the separation of A.M. DIGEST Woman dies of crash injuries A Wyoming County woman has died as a result of injuries suffered in a March crash on Interstate 390, the Livingston County Sheriff's Department announced yesterday. Sophie, Chastek, 86, of Silver Springs died Wednesday at Strong Memorial Hospital, where she had been since the accident, the Sheriff's Department said. The accident happened about 11:40 a.m. March 27 near Exit 4 in Dansville.

Chastek and her husband, Louis, were riding in a van that entered I-390 southbound and pulled into the path of a tractortrailer, which tried to stop but was unable to do so, according to police. The collision caused the truck to jackknife and come to rest in the median, while the van crossed the median and struck a guardrail in a northbound lane of I-390. Louis Chastek, 88, remained in guarded condition yesterday at Strong Memorial Hospital. "This, frankly on the merits, is one of the most important constitutional disputes to come before the court in 50 years," Steven Reiss, the lawyer representing Silver told the sevenjudge panel. Pataki vetoed 55 items out of the 1998-99 state budget. New York gives its governors lineitem veto power. The $1.6 billion worth of vetoes mainly targeted Democratic spending projects. Silver contended veto power is limited to spending items, and Pataki overstepped his authority when he deleted sections directing legislative policy on the budget.

Striking nonappropriation bills is "unconstitutional," Reiss contended. Hearing centers offer screenings Free hearing screenings will be offered tomorrow at area hearing centers.
