The idea was one of several wel fare reforms being promoted by Republicans who control the state Sen ate. A similar program in Maryland required a waiver from the federal government to change welfare requirements. There could be some short- term, immediate savings from this Judge approves reorganization BROTHERS from page IB million owed to individuals who lent the village money as part of its controversial and unorthodox Loan Program, court papers show. Unsecured creditors will receive about 15 cents on the dollar under the plan. Former employees and others have acknowledged problems in the Loan Program, including deceiving potential lenders about the safety of their loans.

Brothers has told former em ployees and others he viewed the loans as gifts and never intended to repay them. "The debtor has arrived at a plan that will do the best for the creditors in this situation," David D. MacK-night, the lawyer for Freedom Village, said yesterday. Ninfo took the somewhat unusu al step of reading his decision into the court record, saying the nature of the case and the publicity it had attracted made it different from most in bankruptcy court. The village and Brothers have been investi gated by several law enforcement agencies, but no criminal charges have ever been filed.

Ninfo referred to those investiga Trust wounded in Rochester fight RTA from page IB fying the tentative settlement would prevent implementation of a "legitimate accountability system within any reasonable time line." Yesterday, Curren affirmed his view. "Right now, my opinion is that labor and management in the school district are fighting to maintain the trust in each other that had been in the last contract," he said. The board's rejection also will damage city school reforms in general, Curreri said. "I consider that unfortunate," he said of the board's decision. "I hope, if you quote me six months to a year from now, I'm not using the word tragic instead of unfortunate." Urbanski and Rivera echoed Curreri's feeling that the present atmosphere will hamper reform.

We have a mess on our hands, Urbanski said. "It does jeopardize all of our work. The teacher morale is lower than it was during the strike of 1980." Teachers will not support district initiatives, he said. They'll only do what is required by contract. Rivera said the union and dis trict had been making progress on various issues, including account ability and safety.

Without this tentative agree ment, there's a likelihood that some of those efforts may cease," he said. I just hope that, as profession als, we can separate out the work that absolutely must go on to bring about change in our system, while district and union try to resolve a collective bargaining agreement," Rivera said. The RTA has filed improper labor practice charges against the district with PERB. Ninfo also said that, while the village will continue to operate, potential supporters and law enforcement authorities may "more closely scrutinize the operations of the debtor to insure that whatever good work is done at Freedom Village and by the ministry in general continues, and whatever abuses that there may have been, if any, do not occur in the future." Trudy A. Nowak, the lawyer in the U.S.

trustee's Office who handled the village's case, said that it appeared Ninfo put some limits on the village that might prevent the financial problems that surrounded this bankruptcy the village's second since 1982. Among the precautions, Ninfo ordered that the village's written solicitations for money be reviewed for accuracy by James Weller, who is to supervise the distribution of creditors' payments. Weller, however, told the judge that a lack of resources would make that difficult "I think," Nowak said of the judge, "that he's trying to do whatever he can be done without having to go in and run the company." er says the district violated the contract by not including teachers when the superintendent identified schools that needed help. In Buffalo, where teachers have been without a contract for more than two years, the union also has filed improper practice charges, Curreri said. In his letter, Curreri cautioned Rivera and Urbanski that rejecting the proposed contract could foster the same type of "contentious" climate in Rochester.

Though a factfinder will be appointed to step in, the teachers and the school board still have the last word in contract talks, he said.
